Shura Council Discusses Draft Law on Combating Conflict of Interest

Doha: The Shura Council held its regular weekly meeting, via video conference on Monday, under the chairmanship of HE the Speaker Ahmed bin Abdullah bin Zaid Al Mahmoud.
At the outset of the meeting, the Council discussed a draft law on combating conflict of interest.
The draft law includes 5 chapters and 29 articles, and according to its provisions, the employee must arrange his personal affairs and interests in a manner that prevents any conflict with the public interest or with the duties or responsibilities of his position or job. The draft law specifies cases of conflict of interest and mechanisms for combating conflict of interest, as well as penalties for anyone who violates its provisions.
After discussion, the Shura Council decided to refer the aforementioned draft law to the Legal and Legislative Affairs Committee for study and to submit a report thereon to the Council.
The Council reviewed the report of the Legal and Legislative Affairs Committee on a draft law on the protection of trademarks, copyright and rights related to the International Federation of Association Football (FIFA).
The draft law includes 12 articles, and its provisions require the registration of FIFA trademarks, and the deposit of works and audio recordings, performances of performers and FIFA radio programmes with Intellectual Property Protection Department at the Ministry of Commerce and Industry, and specify the procedures to be taken regarding the registration.
The Council was also briefed on the report of the joint committee of the Internal and External Affairs Committee and the Legal and Legislative Affairs Committee on a draft law issuing a law on the Shura Council’s electoral system.
After discussing the two reports, the Council approved the two aforementioned draft laws as received from the esteemed government.
HE the Speaker of the Shura Council briefed the Council on the ongoing preparations for the opening of United Nations Office of Counter-Terrorism (UNOCT) Programme Office which is concerned with parliamentary engagement in preventing and combating terrorism, which will be inaugurated on Wednesday in Doha with the participation of a number of senior parliamentarians in the world and senior officials of the United Nations.

الدوحة: عقد مجلس الشورى جلسته الأسبوعية العادية، يوم الأمس، برئاسة سعادة السيد أحمد بن عبدالله بن زيد آل محمود رئيس المجلس، وذلك عبر تقنية الاتصال المرئي بمقر المجلس.
وناقش المجلس في بداية جلسته مشروع قانون مكافحة تضارب المصالح .
ويشتمل مشروع القانون على (29) مادة مضمنة في (5) فصول، ويتعين على الموظف بموجب أحكامه ترتيب شؤونه ومصالحه الخاصة على نحو يمتنع معه تضاربها مع المصلحة العامة أو مع واجبات أو مسؤوليات منصبه أو وظيفته. ويحدد مشروع القانون حالات تضارب المصالح وآليات مكافحة تضارب المصالح ، كما يحدد العقوبات لكل من يخالف أحكامه.
وبعد المناقشة قرر المجلس إحالة مشروع القانون المذكور إلى لجنة الشؤون القانونية والتشريعية لدراسته وتقديم تقرير بشأنه إلى المجلس.
واطّلع المجلس على تقرير لجنة الشؤون القانونية والتشريعية حول مشروع قانون بشأن حماية العلامات التجارية وحقوق المؤلف والحقوق المجاورة الخاصة بالاتحاد الدولي لكرة القدم (فيفا).
ويشتمل مشروع القانون على (12) مادة، وتقضي أحكامه بتسجيل العلامات التجارية الخاصة بـ (الفيفا)، وإيداع المصنفات والتسجيلات السمعية وأداءات فناني الأداء والبرامج الإذاعية الخاصة به لدى مكتب حماية الملكية الصناعية، بوزارة التجارة والصناعة ويحدد الإجراءات الواجب اتخاذها بشأن التسجيل.
كما اطّلع المجلس على تقرير اللجنة المشتركة المشكلة من لجنة الشؤون القانونية والتشريعية ولجنة الشؤون الداخلية والخارجية حول مشروع قانون بإصدار قانون نظام انتخاب مجلس الشورى.
وبعد مناقشة التقريرين وافق المجلس على مشروعي القانونين المذكورين كما وردا من الحكومة الموقرة.
واطلع سعادة رئيس مجلس الشورى المجلس خلال الجلسة على الاستعدادات الجارية لافتتاح مكتب برنامج الأمم المتحدة لمكافحة الإرهاب المعني بالمشاركة البرلمانية في منع الإرهاب ومكافحته، والذي سيتم افتتاحه بعد غد الأربعاء في الدوحة بمشاركة عدد من كبار البرلمانيين في العالم وكبار المسؤولين في الأمم المتحدة.
