A new payroll model for workers next month

Doha: Official sources told Al-Sharq newspaper that the minimum wage recently adopted by the State of Qatar will come into effect on March 20, six months after its publication in the Official Gazette. This step is a milestone in the agenda of labor reform and transition towards a knowledge-based economy, which is included in Qatar’s National Vision 2030.

The new minimum wage will encourage investment in a more skilled and productive workforce and will enhance the protection of workers’ rights and commitment to their duties and increase their enthusiasm during the performance of the job.

The Ministry of Administrative Development, Labor and Social Affairs confirmed that as of March 20th, the overtime calculation must be based on at least the new minimum basic wage and the rate can be higher based on the provisions of the worker’s employment contract. The worker’s wages during annual or sick leave and the end-of-service bonus are calculated on the basis of at least his or her basic wage on the due date of maturity.

Also, from March 20th, the employer is legally obliged to pay the worker at least QR 1,000 per month, even if the contract signed with the worker is paid less than this amount and the law does not require the signing of a new contract for the workers to obtain the new minimum wage.

If the employer pays workers the new minimum wage of QR 1,000 or more with housing and food insurance, the employer will not be obliged to adjust their wages or allowances.

For workers who have been provided with the right housing but who buy their own food, they must be paid at least QR 1,300, reflecting the minimum wage for the food allowance, and the new minimum wage does not directly affect workers earning basic wages above 1,800 riyals because it exceeds the basic minimum wage plus all allowances.

الدوحة: علمت الشرق أن الحد الأدنى للأجور الذي اعتمدته دولة قطر مؤخراً سيدخل حيز التنفيذ في 20 مارس الجاري، أي بعد مرور 6 أشهر على نشره في الجريدة الرسمية، وتعد هذه الخطوة إنجازا بارزا ضمن أجندة إصلاح العمل والانتقال نحو اقتصاد قائم على المعرفة، وهو ما تتضمنه رؤية قطر الوطنية 2030، وسيشجع الحد الأدنى للأجور الاستثمار في قوى عاملة أكثر مهارة وإنتاجية، كما سيعزز حماية حقوق العمال والالتزام بواجباتهم ويزيد من حماسهم خلال تأدية العمل.

وأكدت وزارة التنمية الإدارية والعمل والشؤون الاجتماعية انه اعتبارا من 20 مارس الجاري يجب أن يستند حساب العمل الإضافي إلى ما لا يقل عن الحد الأدنى الجديد للأجر الأساسي ويمكن للمعدل أن يكون أعلى بناء على أحكام عقد العمل الخاص بالعامل.. ويحتسب أجر العامل أثناء الإجازة السنوية أو المرضية ومكافأة نهاية الخدمة بناء على ما لا يقل عن أجره الأساسي في تاريخ الاستحقاق.

وأيضا ابتداء من 20 مارس الجاري يصبح صاحب العمل ملزما قانونيا بأن يدفع للعامل ما لا يقل عن 1000 ريال قطري شهريا حتى إذا نص العقد الموقع مع العامل على أجر يقل عن هذا المبلغ ولا يشترط القانون توقيع عقد جديد حتى يتمكن العمال من الحصول على الحد الأدنى الجديد.

وإذا كان صاحب العمل يدفع للعمال الحد الأدنى الجديد للأجور أي 1000 ريال قطري أو أكثر مع تأمين حصولهم على السكن والغذاء فلن يكون صاحب العمل ملزما بتعديل أجورهم أو البدلات التي يتلقونها.

أما بالنسبة إلى العمال الذين تم توفير السكن المناسب لهم ولكنهم يشترون طعامهم الخاص فيجب أن يتقاضوا أجرا لا يقل عن 1300 ريال قطري بما يعكس الحد الأدنى لبدل الغذاء ولا يؤثر الحد الأدنى الجديد للأجور بشكل مباشر على العمال الذين يكسبون أجرا أساسيا أعلى من 1800 ريال لأنه يفوق الحد الأدنى للأجر الأساسي بالإضافة إلى جميع البدلات.
