Important statement from MME for the owners of companies regarding the housing of workers on farms
بيان هام من “البلدية والبيئة” لأصحاب الشركات بشأن سكن العمال بالمزارع

The Ministry of Municipality and Environment has called on the owners of companies not to conclude any housing contracts for workers to house workers on farms, with the owners of the farms.
The ministry said in a statement via Twitter, “These contracts are illegal and do not constitute a valid argument against the ministry due to its violation of the provisions of Law No. 2 of 2013 by amending some provisions of Law No. 10 of 1987 on public and private property, which contained an order that included “agricultural land must be used for the purposes of agricultural activity only, and agricultural activity may not be changed to another activity.”
The statement added: It is also prohibited to exploit farms in commercial and industrial activities of various kinds, such as workshops, factories, warehouses and so on, since the practice of such activities within the farms is contrary to the provisions of Law No. 2 of 2013 mentioned above, and contrary to its provisions.
The Ministry continued: Since the rules contained in these laws are jus cogens concerning public order in the State of Qatar and therefore it is not permissible to agree to violate its provisions and any agreement that violates this is invalid, in addition to subjecting those who violate those provisions to legal liability.

أهابت وزارة البلدية والبيئة بالسادة أصحاب الشركات بعدم إبرام أية عقود سكن عمال لتسكين العمال داخل المزراع، وذلك مع السادة أصحاب المزارع وحائزيها.
وقالت الوزارة في بيان عبر تويتر، إن “هذا العقود غير قانونية ولا يحتج بها في مواجهة الوزارة نظراً لمخالفتها لأحكام القانون رقم 2 لسنة 2013 بتعديل بعض أحكام القانون رقم 10 لسنة 1987 بشان أملاك الدولة العامة والخاصة والذي تضمن نصاً أمراً بمقتضاه “يجب أن تستغل الأراضي الزراعية في أغراض النشاط الزراعي دون غيره، ولا يجوز تغيير النشاط الزراعي إلى نشاط آخر”.
وأضاف البيان: كما أنه يحظر استغلال المزارع في الأنشطة التجارية والصناعية بأنواعها المختلفة كالورش والمصانع والمخازن ونحوها نظراً لأن ممارسة تلك الأنشطة داخل المزراع يعد مخالفاً لأحكام القانون رقم 2 لسنة 2013 المذكور أعلاه، ويتعارض مع أحكامه.
وتابعت الوزارةة: نظراً لأن القواعد الواردة بتلك القوانين هي من القواعد الآمرة التي تتعلق بالنظام العام في دولة قطر ومن ثم فإنه لا يجوز الاتفاق على مخالفة أحكامها ويقع باطلاً كل اتفاق يخالف ذلك، هذا بالإضافة إلى خضوع من يخالف تلك الأحكام للمشاءلة القانونية.
