EU Commission fines four consumer electronics companies for competition breaches

The EU Commission has today announced fines of €111m (£98.9m) for four consumer electronics companies which breached competition rules.

Philips, Pioneer, Asus and Denon & Marantz were all fined for breaches of EU e-commerce rules related to fixed or minimum re-sale prices on their products.

The collective fines of over €111m were reduced as the companies cooperated with with the Commission.

Commissioner Margrethe Vestager, in charge of competition policy, said: “As a result of the actions taken by these four companies, millions of European consumers faced higher prices for kitchen appliances, hair dryers, notebook computers, headphones and many other products.

“This is illegal under EU antitrust rules. Our decisions today show that EU competition rules serve to protect consumers where companies stand in the way of more price competition and better choice.”

The four firms engaged in fixed or minimum re-sale price maintenance where they restricted the ability of online retailers to set their own retail prices for products.

If online retailers did not comply with minimum prices, the companies faced threats or sanctions such as blocking of suppliers.

The price intervention limited effective competition and led to higher prices for consumers.

All four companies had their fines reduced after working with the Commission and acknowledging their breach of EU competition rules.

Asus was fined €63.5m, reduced by 40 per cent, Philips €29.8m reduced by 40 per cent, Pioneer €10.1m reduced by 50 per cent and Denon & Marantz €7.7m reduced by 40 per cent.

A spokesperson for Philips said: “Since the start of the EC investigation in late 2013, which Philips reported in its annual reports, the company has fully cooperated with the EC. Philips initiated an internal investigation and addressed the matter in 2014.”

Pioneer, Asus and Denon & Marantz were contacted for comment.

فرضت المفوضية الأوروبية، أمس، غرامة قدرها 111 مليون يورو (ما يعادل 130 مليون دولار) على 4 شركات إلكترونية؛ لانتهاكها قواعد المنافسة بالاتحاد الأوروبي، بعد أن قامت كل منها بتحديد أسعار سلعها التي أُعيد بيعها من قبل تجار البيع بالتجزئة عبر الإنترنت. وبحسب الموقع الإلكتروني للمفوضية الأوروبية، فإن الشركات التي جرى تغريمها هي «أسوس» و»دينون ومارتنز» و»فيليبس» و»بيونير»، حيث قامت جميعاً بالحد من قدرة تجار البيع بالتجزئة عبر الإنترنت من تسعير سلعهم كما يرونها مناسبة. وهددت الشركات الأربع أو عاقبت على ما يبدو التجار عبر الإنترنت الذين لم يمتثلوا لأسعارهم المقترحة، من خلال منع تزويدهم بالسلع والمنتجات.

وقُدّرت الغرامات على الشركات الأربع كالتالي: «أسوس» 63.5 مليون يورو، و»دينون ومارتنز» 7.7 مليون يورو، و»فيليبس» 29.8 مليون يورو، و»بيونير» 10.2 مليون يورو. وقالت السيدة مارجريت فيستاجر -مفوضة الاتحاد الأوروبي لشؤون المنافسة- في مؤتمر صحافي، إن «هؤلاء مصنّعون معروفون لمستهلكي الإلكترونيات، وقد فرضوا ضغطاً على تجار البيع بالتجزئة عبر الإنترنت للحفاظ على أسعار أعلى. وقد فعلوا ذلك خلال الفترة من 2011 إلى 2015».

وأضافت: «نتيجة للأفعال التي قامت بها الشركات الأربع، اشترى ملايين المستهلكين الأوروبيين العديد من المنتجات بأسعار أعلى، منها أدوات المطبخ، ومجففات الشعر، وأجهزة الكمبيوتر المحمول، وسماعات الأذن، والعديد من المنتجات الأخرى»، واصفة هذا السلوك بأنه «غير قانوني» بموجب قواعد الاتحاد الأوروبي لمكافحة الاحتكار.;
