Two months in prison for the supermarket thief

Doha: The Court of Appeal upheld the criminal court’s ruling punishing a worker with two months’ imprisonment and deporting him from the country following the execution of the penalty after he was convicted of attempting to rob a supermarket in the industrial area.

The facts of the case indicate that the accused broke into a famous supermarket in the industrial area and while he was trying to steal some of the store’s contents, the supermarket employees saw him and caught him and contacted the police who arrested him.

In the police report, the accused confessed to the theft, so he was referred to the Criminal Court, which sentenced him to two months in prison and then deporting him from the country after the execution of the sentence. However, the accused was not satisfied with the verdict, so he appealed against it before the Court of Appeal, which issued its aforementioned verdict supporting the verdict of the Court of First Instance.

The court said reasoning its ruling, that the accused exceeded the deadline set by the law to file the appeal, which requires the judiciary not to accept the appeal in form of filing it after the time limit.

الدوحة: أيدت محكمةُ الاستئناف حكم محكمة الجنايات بمُعاقبة عامل بالحبس شهرَين وإبعاده عن البلاد عقب تنفيذ العقوبة بعد إدانته بالشروع في سرقة محل سوبر ماركت بالصناعيّة.

تُشير وقائع القضية إلى أنَّ المتهم دلف إلى محل سوبر ماركت شهير بالصناعية وأثناء قيامه بمحاولة سرقة بعض محتويات المحل شاهده موظفو السوبر ماركت فقاموا بضبطه والاتصال بالشرطة التي ألقت القبضَ عليه.

اعترف المتهم في محضر الشرطة بالشروع في السرقة فتم إحالته إلى محكمة الجنايات التي قضت بمعاقبته بالحبس شهرَين وإبعاده عن البلاد عقب تنفيذ العقوبة، غير أنّ المتهم لم يرتضِ الحكمَ فقام بالطعن عليه أمام محكمة الاستئناف التي أصدرت حكمَها المتقدّم بتأييد حكم محكمة أوّل درجة، وقالت المحكمة في أسباب حكمها: إنَّ المتهم تجاوز الميعاد الذي حدّده القانون لتقديم الاستئناف بما يتعيّن معه القضاء بعدم قَبول الاستئناف شكلًا للتقدّم به بعد الميعاد.
