New Batch of Qatari Real Estate Brokers Obtains License

Doha: A new batch of licensed Qatari real estate brokers took the legal oath before the Real Estate Brokers Affairs Committee at the Ministry of Justice, including 28 mediators between individuals and real estate brokerage companies.

The licensing of this new batch comes in the context of the Ministry of Justice’s activation of Law No. 22 of 2017 on regulating real estate brokerage, in the framework of the executive procedures for the provisions of the law and in pushing real estate brokerage work towards an established and organized legal environment. This takes place in keeping with the rapid pace of economic and urban development that Qatar is undergoing, especially with the great expansion of the real estate sector, in addition to providing the necessary reconfiguration and organization of the real estate system to achieve the objectives of Qatar National Vision 2030.

The Assistant Undersecretary for Real Estate Registration and Documentation Affairs and Chairperson of the Real Estate Brokers Affairs Committee Saeed Abdullah Al Suwaidi welcomed the new batch of licensed brokers.

He stressed the Ministry’s keenness to advance the real estate brokerage profession, as HE Minister of Justice Masoud bin Mohammed Al Amri pays special attention to the development of the legal profession in line with the objectives of the Qatar National Vision 2030, due to its direct impact on the national development process – given that the real estate sector is one of its main pillars.

Al Suwaidi stressed the need to deal with licensed brokers; because of the importance of this to protect the rights of different parties. He warned against dealing with unlicensed brokers after the expiry of the period to reconcile the situation and start activating the real estate mediation law.

He pointed out the need to adopt contract forms for real estate brokers in buying and selling transactions to ensure the rights of dealers and brokers.

This step comes within the framework of the efforts of the Ministry of Justice to reorganize the real estate brokerage profession, and to work in accordance with the provisions of Law No. 22 of 2017 regulating real estate brokerage work, in a way that serves the national economy, developing work mechanisms in the real estate market, and qualifying Qatari office owners and brokers working in the brokerage profession.

The Ministry notes the necessity of dealing with real estate brokers licensed by the Ministry to avoid legal violations resulting from carrying out mediation work without a license.

The license for this batch came after completing the specific regulatory procedures under the provisions of the law, which include interviewing applicants for the profession’s work, inspecting their offices, ensuring their compliance with the requirements for practicing the profession, and participating in specialized training courses at the Legal and Judicial Studies Center (CLJS).

The license for the new batch comes within the framework of the Ministry of Justice’s efforts to reorganize the real estate brokerage profession and activate regulatory procedures to serve the national economy, develop work mechanisms in the real estate market, qualify those working in the profession of real estate brokerage among Qatari office owners and brokers, maximize interest in favor of Qatari real estate brokers as partners in real estate investment and establish advanced real estate brokerage offices in the region.

The Real Estate Brokerage Department receives and sorts the applications and organizes the required training courses to ensure that the applicant to practice the real estate brokerage profession obtains all the professional and legal requirements to carry out his role in this sector in an optimal manner.
As part of its plan to train and qualify real estate brokers, the Real Estate Brokerage Department, since the law went into effect, has implemented an integrated plan that includes training and qualification, activating the executive procedures of the law, including organizing visits to offices operating in the sector, and nominating applicants to practice the profession for training courses that are subject to licensing controls.

الدوحة: أدت دفعة جديدة من الوسطاء العقاريين القطريين المرخص لهم ،اليمين القانونية، أمام لجنة شؤون الوسطاء العقاريين بوزارة العدل، حيث شملت الدفعة 28 وسيطا، ما بين أفراد وشركات للوساطة العقارية.

ويأتي الترخيص لهذه الدفعة، منذ بدء وزارة العدل تفعيل القانون رقم (22) لسنة 2017 بتنظيم أعمال الوساطة العقارية، في إطار الإجراءات التنفيذية لأحكام القانون، والدفع بأعمال الوساطة العقارية نحو بيئة قانونية منظمة ومهيأة لمواكبة النهضة الاقتصادية والعمرانية التي تشهدها الدولة والتوسع الكبير في القطاع العقاري، مع ما يستلزمه ذلك من إعادة تهيئة وتنظيم المنظومة العقارية لتحقيق أهداف رؤية قطر الوطنية 2030.

ورحب السيد سعيد عبدالله السويدي، وكيل الوزارة المساعد لشؤون التسجيل العقاري والتوثيق رئيس لجنة شؤون الوسطاء العقاريين، بالدفعة الجديدة من الوسطاء المرخص لهم.

وأكد حرص الوزارة على الارتقاء بمهنة الوساطة العقارية، مشيرا إلى أن سعادة السيد مسعود بن محمد العامري وزير العدل يولي اهتماما خاصا لتطوير المهن القانونية بما ينسجم مع أهداف رؤية قطر الوطنية 2030، ومن بين هذه المهن مهنة الوساطة العقارية، لما يترتب عليها من نتائج ذات صلة مباشرة بمسيرة التنمية الوطنية، التي يعتبر القطاع العقاري إحدى ركائزها الأساسية.

وشدد السويدي على ضرورة أن يكون التعامل مع الوسطاء المرخص لهم لما لذلك من أهمية لحماية حقوق مختلف الأطراف، وحذر من التعامل مع الوسطاء غير المرخص لهم بعد انتهاء مهلة توفيق الأوضاع، والبدء في تفعيل قانون الوساطة العقارية.

كما نوه إلى ضرورة اعتماد نماذج العقود الخاصة بالوسطاء العقاريين في معاملات البيع والشراء، لضمان حقوق المتعاملين والوسطاء.

وتأتي هذه الخطوة في إطار جهود وزارة العدل لإعادة تنظيم مهنة الوساطة العقارية، والعمل بموجب أحكام القانون رقم (22) لسنة 2017 بتنظيم أعمال الوساطة العقارية، بما يخدم الاقتصاد الوطني، وتطوير آليات العمل بالسوق العقارية، وتأهيل المشتغلين بمهنة الوساطة من أصحاب المكاتب والوسطاء القطريين.

وتنوه الوزارة بضرورة التعامل مع الوسطاء العقاريين المرخص لهم من الوزارة، وذلك تجنبا للمخالفات القانونية المترتبة على القيام بأعمال الوساطة دون ترخيص.

وجاء الترخيص لهذه الدفعة، بعد استكمال الإجراءات التنظيمية المحددة بموجب أحكام القانون، والتي تشمل مقابلة المتقدمين لأعمال المهنة ومعاينة مكاتبهم، والتأكد من مطابقتها لمتطلبات مزاولة المهنة، والمشاركة في الدورات التدريبية التخصصية بمركز الدراسات القانونية والقضائية.

ويأتي الترخيص للدفعة الجديدة في إطار جهود وزارة العدل لإعادة تنظيم مهنة الوساطة العقارية وتفعيل الإجراءات التنظيمية بما يخدم الاقتصاد الوطني، ويطور آليات العمل بالسوق العقارية، ويؤهل المشتغلين بمهنة الوساطة العقارية من أصحاب المكاتب والوسطاء القطريين، وتعظيم الفائدة لصالح الوسطاء العقاريين القطريين باعتبارهم شركاء في الاستثمار العقاري، ويؤسس لإيجاد مكاتب وساطة عقارية متطورة على مستوى المنطقة.

وتتولى إدارة الوساطة العقارية، استقبال وفرز الطلبات وتقوم بتنظيم الدورات التدريبية المطلوبة، بالتنسيق مع قسم التدريب بمركز الدراسات القانونية والقضائية، بما يضمن حصول المتقدم لممارسة مهنة الوساطة العقارية على كافة المتطلبات المهنية والقانونية للقيام بدوره في هذا القطاع على الوجه الأمثل.

وفي إطار خطتها لتدريب وتأهيل الوسطاء العقاريين، باشرت إدارة الوساطة العقارية منذ بدء العمل بتفعيل القانون تنفيذ خطة متكاملة تشمل التدريب والتأهيل، وتفعيل الإجراءات التنفيذية للقانون، بما في ذلك تنظيم زيارات للمكاتب المشتغلة بالقطاع، وترشيح المتقدمين لممارسة المهنة للدورات التدريبية التي تخضع لضوابط الترخيص .
