SJC, MADLSA hold labour dispute sessions remotely

The Supreme Judicial Council (SJC) in cooperation with the Ministry of Administrative Development, Labor, and Social Affairs (MADLSA), began holding sessions of the  Labor Dispute Resolution Committee (LDRC) “remotely” to decide on urgent cases and requests. 

The sessions were held through the use of the visual communication technology currently adopted by SJC in holding trial sessions as part of the preventive measures and efforts to curb  the spread of the coronavirus.

It is scheduled to hold the sessions of the committees for the settlement of labour disputes at the headquarters of the committees in the Al Huda Tower of the Ministry by allocating a hall equipped with visual communication means.  The workers who do not have appropriate means of communication will attend the day specified during the session, to communicate visually with the judge in charge of labour disputes, who will for his part be connected to the visual communication system, as well as the communication of other stakeholders is also visible, similar to the employers through a link sent to them from the Ministry.

The  sessions using the visual communication technology will allow urgent cases to be considered, and the Ministry will also provide full technical support to workers who do not have adequate means of communication and attend the session headquarters at the dates set for them.

This approach to holding such sessions comes within the framework of keenness to protect the rights of workers and employers and to provide a healthy and safe environment for the resolution of disputes that may arise between them with appropriate precautions.

بدأ المجلس الأعلى للقضاء بالتعاون مع وزارة التنمية الإدارية والعمل والشؤون الاجتماعية عقد جلسات لجنة فض المنازعات العمالية “عن بعد” للبت في القضايا والطلبات المستعجلة، وذلك من خلال استخدام تقنية الاتصال المرئي التي يعتمدها المجلس حاليا في عقد جلسات المحاكمات وفي إطار التدابير الوقائية ضمن جهود الحد من انتشار فيروس كورونا (كوفيد-19).

ومن المقرر في هذا الإطار أن يتم عقد جلسات لجان فض المنازعات العمالية في مقر اللجان في برج الهدى التابع لوزارة التنمية الإدارية والعمل والشؤون الاجتماعية من خلال تخصيص قاعة مجهزة بوسائل الاتصال المرئي يحضر فيها العامل الذي لا يملك وسائل التواصل المناسبة في اليوم المحدد لجلسته، ليتواصل مرئيا مع القاضي المكلف بالنظر في النزاع العمالي والذي سيكون متصلا من جهته بنظام الاتصال المرئي إلى جانب تواصل المعنيين الآخرين مرئيا أيضا على غرار أرباب العمل من خلال رابط يرسل لهم من الوزارة.

وستتيح خاصية عقد الجلسات عن بعد باستخدام تقنية الاتصال المرئي النظر في القضايا المستعجلة بناء على طلب العامل أو صاحب العمل، كما ستتكفل الوزارة بتقديم الدعم التقني الكامل للعمال الذين لا يملكون وسائل تواصل مناسبة ويحضرون لمقر الجلسة في المواعيد المحددة لهم مسبقا.

ويأتي هذا التوجه لعقد مثل هذه الجلسات في إطار الحرص على حماية حقوق العمال وأرباب العمل وتوفير بيئة صحية وآمنة للفصل في المنازعات التي قد تنشأ بينهم مع اتخاذ الإجراءات الاحترازية المناسبة.

ويحرص المجلس الأعلى للقضاء ووزارة التنمية الإدارية والعمل والشؤون الاجتماعية على البت في القضايا العمالية لتحقيق العدالة المطلوبة بين العمال وأرباب العمل وإنصاف كلا الطرفين قانونيا، وذلك في جميع الظروف والأوضاع الناشئة عن أزمة فيروس كورونا.
