Housing over five workers within family residential areas is violation: Ministerial Decision

The Minister of Municipality and Environment H E Abdullah bin Abdulaziz bin Turki Al Subaie has issued a decision which stipulates that housing over five workers in a place within family residential areas is a violation of the law banning labour camp in family residential areas.
The Ministerial Decision No. 105 for the year 2020 has been issued to specify family residence areas and what is considered workers’ accommodations within those areas and the exceptions mentioned therein, said the Ministry in a release.
This decision comes in implementation of the provisions of Law No. (15) for the year 2010 regarding the ban on labour accommodation within family residential areas, as amended by Law No. 22 of 2019.
The decision stipulates that housing more than five workers in a place within the family residential areas is considered violation of the law.
The Ministerial Decision has excluded female workers from its provision regardless the nature of their work, as well as the housing of domestic workers and those come in this category, such as housemaids and drivers.
The legal procedures provided in the law requires to issue a warning to the violator, whether landlord, tenant or both.
After recording the violation, the violator will be asked to vacate the workers residing in erring accommodation.
In case of non-compliance, forced eviction of the building, as well as cutting the electricity and water connection of the violating residence will be carried out.
The law stipulates to punish the violators with jail sentence upto to six month and fine from QR50,000 to QR100,000 or one of them.
The law allowed for the Minister of Municipality and Environment or his representative to make reconciliation with violators against half of the maximum fine which is QR50,000 and vacating the violating housing from the workers.
The decision comes within the framework of the Ministry’s efforts to protect the health of workers and limit the gathering of over five workers in an accommodation in family residential areas.
It also aims at limiting the phenomenon of informal housing, which does not meet the specifications of adequate housing for workers.
The Ministry of Municipality and Environment called upon everyone to abide by the provisions of the aforementioned decision to avoid legal action.

أصدر سعادة المهندس عبدالله بن عبدالعزيز بن تركي السبيعي وزير البلدية والبيئة القرار الوزاري رقم (105) لسنة 2020 بتحديد مناطق سكن العائلات وما يُعد تجمعاً للعمال داخل تلك المناطق والاستثناءات الواردة عليها.
يأتي هذا القرار تنفيذاً لأحكام القانون رقم (15) لسنة 2010 بشأن حظر سكن العمال داخل مناطق سكن العائلات المعدل بالقانون رقم 22 لسنة 2019.
وتضمن القرار الوزاري تحديد ما يُعد تجمعاً للعمال داخل مناطق سكن العائلات ، حيث قضى بأن سكن أكثر من خمسة عمال في أحد الأماكن داخل مناطق سكن العائلات يُعد مخالفاً لأحكام القانون، ومن ثَمَّ تُطبق عليه الإجراءات القانونية المنصوص عليها في القانون، والتي تتمثل في توجيه إنذار للمخالف سواء كان المؤجر أو المستأجر أو كليهما، بالإضافة إلى تحرير محضر ضبط بالواقعة ، ومن ثَمَّ المطالبة بإخلاء العقار من سكن العمال المخالف، وأنه في حالة عدم الامتثال يتم الإخلاء الجبري للمبنى المخالف، وكذلك قطع التيار الكهربائي والماء عن السكن المخالف، علماً بأن العقوبة المنصوص عليها في حالات المخالفة هي الحبس مدة لا تُجاوِز ستة أشهر والغرامة التي لا تقل عن (50.000) ريال ولا تزيد على (100.000) ريال أو إحدى هاتين العقوبتين .
ولقد سمح القانون لسعادة وزير البلدية والبيئة أو من ينيبه التصالح مقابل سداد نصف الحد الأقصى للغرامة إلى سداد (50.000) ريال بالإضافة إلى إخلاء السكن المخالف من العمال .
ولقد استثنى القرار رقم (105) لسنة 2020 المذكور من أحكامه كل من سكن العاملات أياً كانت طبيعة عملهن وكذلك سكن المستخدمين في المنازل ومن في حكمهم كالخدم والسائقين
يأتي هذا القرار الوزاري في إطار جهود الوزارة في المحافظة على صحة العمال والحد من تجمع العمال في سكن واحد فيما يجاوز خمسة عمال، بالإضافة إلى الحد من ظاهرة السكن العشوائي غير النظامي والذى لا تتوافر فيه مواصفات السكن الملائم للعمال.
وأهابت وزارة البلدية والبيئة بالجميع بوجوب الالتزام بأحكام القرار المشار إليه وإخلاء جميع مساكن العمال من العمالة الزائدة حتى لا يخضعون للمساءلة القانونية.
