Qatar details its WTO challenge to Saudi Arabia’s failure to stop copyright piracy

DOHA: The Ministry of Commerce and Industry announced yesterday that it has filed and published its First Written Submission in the State of Qatar’s challenge to the Saudi Arabia’s failure to protect intellectual property in accordance with its international obligations as a Member of the World Trade Organization (WTO).

The dispute is currently being considered by a WTO Panel, which will evaluate the multiple claims brought by Qatar under the WTO’s Agreement on Trade-related Aspects of Intellectual Property Rights (TRIPS Agreement). Qatars first written submission is available here

As detailed in Qatar’s 112-page submission (and supported by 178 exhibits), Saudi Arabia has taken actions that represent not only violations of its obligations to protect intellectual property rights of Qatari nationals, but also the rights of nationals from other trading partners, including (among many others) the United States and the European Union.

Qatar explains how Saudi Arabia has actively and aggressively violated its obligations under the TRIPS Agreement. More generally, the submission explains how such violations have exposed deep-seated and fundamental flaws in Saudi Arabia’s commitment to providing enforcement procedures consistent with the TRIPS Agreement.

In publishing this submission, Qatar aims to better inform rights holders and countries around the world of the threat that this unchecked piracy creates for intellectual property rights, generally, and the global sports and media industries, in particular. In a global economy whose growth depends on innovation and creativity now more than ever, strong intellectual property protection is critical.

Of particular concern, a sophisticated Saudi-based broadcast pirate named “beoutQ” has been pirating copyrighted media content of a Qatari company – beIN Media Group LLP – in Saudi Arabia and beyond, including through the sale of beoutQ subscriptions and set-top decoder boxes at numerous retail outlets across Saudi Arabia.

In addition to beINs proprietary and licensed content, the beoutQ boxes allow access to thousands of pirated movies, TV shows, and TV channels from around the globe.

Contrary to its obligations under the TRIPS Agreement, Saudi Arabia has, among other things, refused to take any effective action against beoutQ; restricted or otherwise frustrated beINs ability to pursue civil actions before the Saudi courts; denounced beINs requests to investigate and prevent the pirates unauthorized broadcasts; and sponsored public gatherings with beoutQ screenings.

Qatar’s Ministry of Commerce and Industry has stressed that Saudi Arabia’s actions constitute a flagrant violation of Saudis international and moral obligations, a position that Qatar will further demonstrate in the coming months during two oral hearings in Geneva, Switzerland, before the WTO Panel, as well as in additional written submissions.

أعلنت وزارة التجارة والصناعة، أمس، أنها نشرت مذكرة الدفاع الأولى في القضية المرفوعة أمام جهاز تسوية المنازعات في منظمة التجارة العالمية، بشأن القرصنة التي تقوم بها السعودية وانتهاكاتها حقوق الملكية الفكرية وحقوق هيئات البث، والتي تخالف التزاماتها الدولية بصفتها عضواً في منظمة التجارة العالمية.

تقوم حالياً لجنة تحكيم تابعة للمنظمة بالنظر في هذه القضية للبتّ فيها؛ حيث تعمل اللجنة على تقييم الادعاءات المختلفة التي قدّمتها دولة قطر بموجب اتفاقية المنظمة المعنية بجوانب حقوق الملكية الفكرية المتصلة بالتجارة (اتفاقية تريبس). ويمكن الاطلاع على مذكرة الدفاع الأولى التي قدّمتها دولة قطر عبر الرابط التالي: (http://bit.ly/qatarws).

وقد أوضحت دولة قطر، في مذكرتها المفصّلة (ذات الـ 112 صفحة، والمدعمة بـ 178 دليلاً)، أن المملكة العربية السعودية قد اتخذت إجراءات لا تمثّل فقط انتهاكات لالتزاماتها المتعلقة بحماية حقوق الملكية الفكرية للمواطنين القطريين، ولكن أيضاً انتهاكات لحقوق المواطنين من بلدان أخرى عديدة، بما في ذلك الولايات المتحدة والاتحاد الأوروبي.

وتشرح دولة قطر كيف انتهكت السعودية، عن سابق عمد وإصرار، التزاماتها بموجب اتفاقية «تريبس». وبشكل عام، توضح المذكرة كيف كشفت هذه الانتهاكات عن عيوب أساسية وعميقة في التزام المملكة العربية السعودية بتوفير إجراءات إنفاذ للحقوق المنصوص عليها في اتفاقية «تريبس».

حقوق

وسعت دولة قطر، من خلال نشرها هذه المذكرة، إلى لفت انتباه أصحاب الحقوق وكذلك الدول في جميع أنحاء العالم إلى التهديد الذي تسببه هذه القرصنة، والتي يجري غضّ الطرف عنها من قِبل السعودية، لحقوق الملكية الفكرية بشكل عام، وللصناعات العالمية في مجال الرياضة والإعلام بشكل خاص؛ وذلك لأن الحماية الفعالة للملكية الفكرية أصبحت أمراً بالغ الأهمية في الاقتصاد العالمي الحالي الذي يعتمد نموه على الابتكار والإبداع أكثر من أي وقت مضى.

ومما يثير الجدل بشكل أكبر تأسيس شركة قرصنة مقرها السعودية باسم «beoutQ»، لتقوم بسرقة محتوى إعلامي محمي بحقوق النشر للشركة القطرية «beIN Media Group – LLP»، سواء داخل المملكة العربية السعودية أو خارجها، بما في ذلك من خلال بيع اشتراكات «beoutQ» وأجهزة فك التشفير في عدد من منافذ البيع في المملكة العربية السعودية. بالإضافة إلى ذلك، تسمح أجهزة «beoutQ» بالوصول إلى آلاف الأفلام المقرصنة والبرامج والقنوات التلفزيونية من جميع أنحاء العالم بشكل غير قانوني.

إجراءات

وقد رفضت السعودية -من بين أمور أخرى- اتخاذ أي إجراء فعال ضد «beoutQ»، وذلك بشكل مخالف لالتزاماتها بموجب اتفاقية «تريبس»، كما عملت السلطات السعودية على تقييد قدرة «beIN» أو عرقلتها -بشكل أو بآخر- عن متابعة الدعاوى المدنية أمام المحاكم السعودية، كما شجبت طلبات «beIN» للتحقيق ومنع عمليات البثّ غير المصرح بها للقنوات المقرصنة، ورعت عدداً من التجمعات العامة التي جرى فيها تقديم عروض من «beoutQ».

ومن جانبها، أكدت وزارة التجارة والصناعة أن إجراءات السعودية المذكورة أعلاه تشكل انتهاكاً صارخاً لالتزاماتها الدولية والأخلاقية، لافتة إلى أن دولة قطر سوف تعمل على توضيح هذه الانتهاكات من خلال مذكرات دفاعها والجلسات التي ستعقدها لجنة التحكيم التابعة لمنظمة التجارة في جنيف، سويسرا، للبتّ في هذه القضية.
