Qatar urges rights council to act against siege countries’ violations

The State of Qatar called on the United Nations Human Rights Council on Thursday to take active and direct measures to deal with the violations made by the blockading countries against Qatari citizens.

This came during the speech of Deputy Permanent Representative of the State of Qatar to the UN in Geneva Abdullah al-Nuaimi, which took place at an interactive dialogue with the Special Rapporteur concerned with the negative repercussions of coercive measures on human rights, as part of the 39th session of the Human Rights Council.

Al-Nuaimi cited the report by technical mission of the Office of the High Commissioner for Human Rights (OHCHR), which described the measures taken by the blockading countries as unilateral and coercive.

Al-Nuaimi expressed Qatar’s regret that the special rapporteur concerned with the subject failed to take any tangible measures, despite the availability of information regarding those violations and his demands of dealing with them.

The Deputy Permanent Representative of the State of Qatar to the UN in Geneva also cited the verdict by the International Court of Justice requiring the United Arab Emirates (UAE) to implement provisional measures that limit the impact of some of the violations committed against Qatari citizens.

Those measures included allowing Qatari students back into UAE universities they are enrolled in, reuniting families separated by the blockade, and allowing Qatari citizens to seek the UAE judicial system to look into their cases.

Al-Nuaimi stressed on the importance of the verdict, but maintained that the Human Rights Council must work on ending those violations committed by the other blockading countries, as those violations remain in place and their urgent nature requires taking direct and active measures.

The Deputy Permanent Representative of the State of Qatar to the UN in Geneva said that the credibility of the UN Human Rights Council depends on its integrity and independence of its mechanisms in ending human rights violations, and holding those responsible for it accountable.

Al-Nuaimi stressed that the council can never be active if its mechanisms were not, especially the special procedures.

دعت دولة قطر مجلس حقوق الإنسان وآلياته المعنية، إلى السرعة والجدية في اتخاذ إجراءات فاعلة ومباشرة للتصدي للانتهاكات التي ارتكبتها دول الحصار بحق المواطنين القطريين. جاء ذلك في كلمة دولة قطر التي قدمها السيد عبد الله النعيمي نائب المندوب الدائم لوفد الدولة لدى مكتب الأمم المتحدة بجنيف، خلال جلسة الحوار التفاعلي مع المقرر الخاص المعني بالتأثير السلبي للتدابير القسرية الانفرادية على التمتع بحقوق الإنسان، تحت البند الثالث، وذلك في إطار أعمال الدورة التاسعة والثلاثين لمجلس حقوق الإنسان.

ولفت النعيمي إلى التوصيف الذي توصل إليه تقرير البعثة الفنية لمكتب المفوض السامي، التي زارت دولة قطر في نوفمبر الماضي، للوقوف على تأثير أزمة الخليج على حقوق الإنسان، بأن «التدابير» التي اتخذتها دول الحصار «تشكل عناصر رئيسية لتعريف التدابير القسرية الانفرادية».

وأعرب عن أسف دولة قطر لعدم قيام المقرر الخاص المعني بهذا الموضوع بشكل مباشر بأي إجراء ملموس وفاعل في إطار ولايته، رغم تقديم المعلومات المتعلقة بهذه الانتهاكات أكثر من مرة، ومطالبته باتخاذ إجراء بشأنها.

وأشار نائب المندوب الدائم إلى إصدار محكمة العدل الدولية، مؤخراً، قراراً في إطار الدعوى المقامة من دولة قطر ضد الإمارات بخصوص الانتهاكات التمييزية التي صاحبت أزمة الخليج، وذلك بإلزام الإمارات بضمان تنفيذ «تدابير مؤقتة «، تهدف إلى الحد من تأثير بعض الانتهاكات التي ارتكبت بحق المواطنين القطريين، لا سيما الطلاب الذين تم إبعادهم من الجامعات، والأسر المشتركة التي تشتتت بسبب الحصار، بجانب إعطاء المتضررين الحق في اللجوء إلى وسائل التظلم والتقاضي بغرض إنصافهم.

وقال النعيمي إنه رغم أهمية هذا القرار، الذي يؤكد وقوع انتهاكات جسيمة لحقوق الإنسان في إطار هذه الأزمة، إلا أن دولة قطر تعتقد ضرورة أن يعمل مجلس حقوق الإنسان وآلياته المعنية، على التصدي للانتهاكات التي ارتكبتها دول الحصار الأخرى، باعتبار أن الانتهاكات التي تعرض لها هؤلاء المواطنون ملحة وما زالت قائمة، وتتطلب السرعة والجدية في اتخاذ إجراءات فاعلة ومباشرة.

وشدد نائب المندوب الدائم على أن مصداقية مجلس حقوق الإنسان تعتمد بشكل رئيسي على نزاهة واستقلالية آلياته، التي أُنشئت بهدف مساندة المجلس في اتخاذ الإجراءات المناسبة بشأن وقف انتهاكات حقوق الإنسان، وإنصاف الضحايا، ومحاسبة المتسببين فيها.

وأكد النعيمي أنه «لا يمكن لهذا المجلس أن يكون فاعلاً إذا لم تكن هذه الآليات، وعلى رأسها آلية الإجراءات الخاصة، بالمستوى المطلوب من المهنية والموضوعية والجدية».;
