MEC detects 89 violations in July

Inspection campaigns conducted by the Ministry of Economy and Commerce (MEC) in the month of July resulted in the detection of 89 violations, it was announced yesterday. In a press statement, the ministry said it intensified its inspection campaigns last month to ensure the compliance of suppliers (retail outlets) with Law No 8 of 2008 on consumer protection.

The MEC stressed that the campaigns came within the framework of its efforts to monitor markets and commercial activities in a bid to crack down on price manipulation and protect consumer rights.

The 89 violations detected included the following: failing to display prices (12); false or misleading product description and advertising (12); failing to display all product-related data (9); lack of spare parts, delays in after-sales service and failure to provide a replacement vehicle (8); failing to offer service warranty for an appropriate period, refunding customers or reoffering the service in an appropriate manner (6); expired products (6); failing to clearly display service data, characteristics and prices (4); failing to post labels on discounted products showing the price before and after discounts (4); failing to issue complete invoices (3); failing to issue invoices in Arabic (3); expired car tyres (3); failing to display prices in Arabic (2); failing to comply with the mandatory price bulletin of vegetables and fruits (2); charging consumers more than the advertised price (2); offering discounts without obtaining a permit from the competent departments (2); failing to comply with the advertised discount percentage (2); an increase in the sale price of locally slaughtered Australian meat (2); failure to immediately notify the competent authority at the MEC after the discovery of a defect in a product or service that would harm the consumer (2); failing to co-operate with a judicial officer (1); failing to separate discounted goods from other products (1); failing to use the Arabic language in data and advertisements related to offered goods (1); failing to sell vegetables and fruits produced locally or imported from wholesalers to retailers through auction (1); and offering a promotion without obtaining a permit from the competent department (1).

The penalties included administrative closures and fines ranging between QR5,000 and QR30,000 in line with the laws and decisions governing the work of the Consumer Protection Department. The ministry has stressed that it will not tolerate any violations of the Consumer Protection Law and its regulations, and will intensify its inspection campaigns to crack down on violations. It will refer those who violate laws and ministerial decisions governing the work of the department to the competent authorities who will, in turn, take appropriate action against the perpetrators in order to protect consumer rights.

قامت وزارة الاقتصاد والتجارة خلال شهر يوليو 2018 بحملات تفتيشية مكثفة لمراقبة مدى تقيد المزودين (المحال التجارية) بالتزاماتهم المنصوصة بالقانون رقم (8) لسنة 2008 بشأن حماية المستهلك، وذلك في إطار حرص الوزارة على مراقبة الأسواق والأنشطة التجارية بالدولة، بهدف ضبط الأسعار والكشف عن التجاوزات حفاظاً على حماية حقوق المستهلكين.

وأسفرت الحملات التفتيشية عن ضبط 89 مخالفة مختلفة تنوعت بين عدم الإعلان عن الأسعار وعدم إصدار فواتير باللغة العربية، وعدم توفير قطع الغيار، والتأخير في خدمة ما بعد البيع وعدم توفير سيارة بديلة، وعدم التحديد بطريقة واضحة لبيانات الخدمة ومميزاتها وخصائصها وأسعارها، وعدم الالتزام بضمان الخدمة التي قام بها خلال فترة زمنية تتناسب مع طبيعة تلك الخدمة وإعادة المبلغ الذي دفعه متلقي الخدمة أو بأدائها مرة أخرى، ووصفاً لسلعة أو الإعلان عنها أو عرضها بأسلوب يحتوي على بيانات كاذبة أو خادعة، وإقامة تخفيضات بدون الحصول على الترخيص، وعدم الالتزام بأسعار النشرة الجبرية للخضروات والفواكه.

عقوبات

هذا وتتراوح العقوبات على المحلات المخالفة ما بين الإغلاق الإداري والغرامات المالية التي تتراوح ما بين 5000 ريال إلى 30000 ريال حسب القوانين والقرارات المنظمة لعمل إدارة حماية المستهلك.

وتؤكد الوزارة أنها ستكون حازمة في وجه كل من يتهاون في القيام بالتزاماته بقانون حماية المستهلك ولائحته التنفيذية، كما ستكثف حملاتها التفتيشية لضبط مثل هذه الممارسات، وستحيل كل من يخالف القوانين والقرارات الوزارية المنظمة لعمل الإدارة إلى الجهات المختصة لاتخاذ الإجراءات المناسبة ضده وذلك حماية لحقوق المستهلكين.;
