Investigation identifies parents of abandoned infant at HIA

Doha: The Public Prosecution issued Monday a statement on Communication numbers 5689 and 6457 for 2020 – Capital Security Department regarding the incident of finding a new-born infant and the violations of the Judicial Police Officers.

The statement said on Oct. 2, 2020, a new-born infant was found in a plastic bag inside a trash can in one of the toilets in the Departures Lounge at Hamad International Airport. Medical attention was immediately provided to her and she was then transferred to one of the childcare centers in the State of Qatar.

Airport security performed its legal duty when searching for the perpetrator, however, some employees violated the procedures, summoning female medical staff at the airport to conduct external examination of female passengers, prior to the passengers being allowed to depart for their destination.

As soon as the Public Prosecution office was informed of the incident, the Public Prosecutor conducted extensive investigations, within all police agencies and specialized technical experts, to gather the facts of the two incidents: the disposal of the new-born infant in a trash can; and the violations by some employees; to determine what potential crimes were committed, arrest those responsible and bring them to criminal prosecution.

The investigation plan was based on summoning all relevant agencies or employees who worked in the crime scene area at the airport and questioning those in charge of the Airport Security Department, Civil Aviation Control Tower, Airport Administration, and DNA examined. The Public Prosecution office also reviewed all correspondence and reports that officials working at the airport exchanged with others at that time and tasked those concerned with reviewing the content of surveillance cameras, audio recordings and phones.

Investigations revealed that the infant’s mother, who holds the nationality of an Asian country, had a relationship with another person of the nationality of one of the Asian countries as well, and this relationship resulted in the infant that was found. The mother, while leaving the country, threw the new-born infant in the trash can in one of the toilets in the Departures Lounge at the Airport and boarded the plane to her destination.

The father of the infant admitted that he had a relationship with the infant’s mother, and that she had sent him a message and a photo of the new-born infant immediately after her birth. The letter included her saying that she had thrown the infant she had given birth to and fled to her country. Examining the DNA of the defendants were identical to that of the infant.

As for the criminal aspect of the case related to the violations by some employees as mentioned above, extensive investigations revealed that some employees of the Airport Security Department acted unilaterally by summoning female medical staff to conduct external examination to some female passengers, thinking that what they had done was within the law as they are Judicial Police Officers authorized in investigating the circumstances of the crime.

The Public Prosecution notes that the violations committed by some employees of the Airport Security Department are against the law and are punishable under the Qatari Penal Code with penalties of a maximum of three years.

The Public Prosecution also notes that the crime of attempting to kill a new-born infant immediately after her birth and in the circumstances in which she was found is one of the most heinous crimes that is against human values, as well as punishable under the Qatari Penal Code with a maximum penalty of fifteen years. The Public Prosecution also notes that it is taking the appropriate legal action within the international judicial cooperation to arrest the fugitive convict.

Accordingly, the Public Prosecutor ordered that the convicts be presented to the Criminal Court to receive a penalty for what they had committed, whether those who threw the new-born infant in the trash can or those Judicial Police Officers who violated laws and regulations.

الدوحة: صدر عن النيابة العامة، يوم الأمس، بيان بشأن البلاغين رقمي 5689 و 6457 لسنة 2020م قسم شرطة العاصمة (واقعتي العثور على طفلة، وتجاوزات مأموري الضبط القضائي).

وأوضح البيان أنه بتاريخ 2 / 10 / 2020 م تم العثور على طفلة حديثة الولادة ملقاة بداخل كيس في سلة مهملات إحدى دورات المياه بصالة المغادرة في مطار حمد الدولي، وكان محور الاهتمام في ذلك الوقت أولاً، وقبل كل شيء، المحافظة على حياة هذه الطفلة، وذلك باتخاذ كافة الإجراءات الطبية اللازمة، وقد تم ذلك بوضعها تحت الاشراف الطبي طوال الوقت ثم إيداعها بإحدى دور رعاية الأطفال بالدولة، وقام أمن المطار بواجبه القانوني والمتمثل في البحث والتحري عن مرتكب تلك الجريمة، إلا أن بعض الموظفين تجاوزوا في الإجراءات -اعتقاداً منهم بصحتها- موجبات القانون، فاستدعوا “الكادر النسائي الطبي العاملات بالمطار ليقمن وحدهن وفقاً للإجراءات الطبية” بإجراء الفحص الظاهري لأولئك المسافرات في مكان خصص لذلك لضبط الأم الفاعلة من بينهن، وتم ذلك ، ثم غادرن المسافرات إلى حيث وجهتهن.

وفور إبلاغ النيابة العامة بالواقعة على النحو السالف البيان، أمر النائب، العام انطلاقا من مسؤولية النيابة العامة القانونية، عن الدعوى الجنائية تحقيقاً واتهاماً، بإجراء التحقيقات الموسعة – في إطار التكامل مع كافة أجهزة الضبط القضائي والخبراء الفنيين المختصين- للوقوف على حقيقة الواقعة “سواء إلقاء الطفلة فور ولادتها في سلة المهملات والعثور عليها أو تجاوزات بعض الموظفين على النحو المتقدم ذكره” بهدف تتبع ما عسى أن يكون قد وقع من جرائم، لضبط المسؤولين عنها وتقديمهم للمحاكمة الجنائية، تحقيقاً للعدالة الناجزة وأسست خطة التحقيق على أساس استدعاء كل من له صلة من أجهزة، أو موظفين معنيين بالعمل في منطقة مسرح الجريمة داخل المطار، فتم سؤال واستجواب بعض القيادات المختصة بإدارة أمن المطار، وبرج مراقبة الطيران المدني، وإدارة المطار، وفحص البصمة الوراثية لأحد الأشخاص المشتبه بهم، كما قامت النيابة العامة بالاطلاع على كافة المراسلات والتقارير التي تبادلها المسؤولون العاملون بالمطار مع غيرهم في تلك الأثناء، وكلفت المعنيين بتفريغ محتوى كاميرات المراقبة والتسجيلات الصوتية والهواتف.

وقد كشفت التحقيقات أن والدة الطفلة، هي من جنسية إحدى الدول الآسيوية، وقد ارتبطت بعلاقة مع شخص آخر من جنسية إحدى الدول الآسيوية كذلك، نجم عن هذه العلاقة الطفلة المعثور عليها، فبادرت الأم أثناء مغادرتها البلاد بإلقاء الطفلة حديثة الولادة في سلة المهملات داخل إحدى دورات المياه بصالة المغادرة بالمطار، واستقلت الطائرة الى وجهتها.

وباستجواب المتهم والد الطفلة، اعترف بعلاقته مع والدة الطفلة، وأنها أرسلت إليه رسالة وصورة للطفلة فور ولادتها، وتضمنت الرسالة أنها قامت بإلقاء الطفلة التي أنجبتها منه وفرت إلى بلادها.

وقد تطابقت نتيجة فحص البصمة الوراثية (DNA) للمتهمين مع البصمة الوراثية للطفلة.

وفي الشق الجنائي المتعلق بالتجاوز الذي وقع من بعض الموظفين على النحو المتقدم ذكره، فقد أسفرت التحقيقات الموسعة عن أن بعض موظفي إدارة أمن المطار، قد تصرفوا بشكل منفرد باستدعاء الكادر الطبي النسائي لإجراء الكشف الظاهري على بعض المسافرات اعتقاداً منهم أن ما قاموا به مطابق للقانون بوصفهم مأموري ضبط قضائي مختصين بالبحث والتحري عن ظروف الجريمة وملابساتها.

وتنوه النيابة العامة بأن ما وقع من بعض موظفي إدارة أمن المطار من تجاوزات هو أمر مخالف للقانون وكذلك عاقب عليه قانون العقوبات القطري بعقوبات يبلغ أقصاها لمدة ثلاث سنوات.

كما تنوه النيابة العامة بأن جريمة الشروع في قتل طفلة رضيعة فور ولادتها، وفي الظروف التي وجدت فيها، لهي جريمة من أبشع الجرائم وأشدها منافاة للقيم الإنسانية، وكذلك عاقب عليها قانون العقوبات القطري، بعقوبة يبلغ أقصاها لمدة خمسة عشر سنة، تحقيقاً للردع بنوعيه الخاص والعام، وتحقيق العدالة، كما تنوه النيابة العامة أنها بصدد اتخاذ الإجراء القانوني المناسب في إطار التعاون القضائي الدولي لضبط المتهمة الهاربة.

بناءً عليه، أمر النائب العام بتقديم المتهمين إلى المحكمة الجنائية لينالوا جزاء ما اقترفت يداهم، سواء من قام بإلقاء الطفلة حديثة الولادة في سلة المهملات أو من خالفوا القوانين واللوائح من موظفي الضبط القضائي.
