MME issues 140 decisions of demolition and maintenance

The Committee for Building Maintenance and Demolition at the Ministry of Municipality and Environment issued 115 decisions for demolition and 25 for maintenance during second quarter (Q2) of this year.

A total of 140 decisions were issued at the rate of 54 decisions in April, 40 in May and 46 in June 2020, said the Ministry in a press release. The committee also received 277 requests — 197 for demolition and 80 for maintenance from the municipalities during the period of study.

So for since it was set up, the committee received a total of 1,178 requests for demolition and 347 for maintenance from municipalities. The necessary actions were taken by issuing appropriate decisions following the law No. 29 of 2006 for monitoring the buildings. The committee issued 1,110 decisions till now.  The committee is assigned to conduct study about the conditions of ramshackle buildings or those require maintenance. 

The job of the committee is to inspect the buildings if it is needed to do so and to take necessary decisions in this regards — asking for conducting maintenance or demolition partly or completely.

The decisions are to be taken as per the safety requirements according to the specification of the Ministry under the rules and regulations of the Law No. 29 of 2006. The committee also takes appropriate decisions about the targeted building giving a complete condition of it including risks posed by the building to the residents, neighbours, passerby and adjacent facilities. 

A per the law, the initiatives in this regards will be taken by the owners of the buildings and the municipality concerned. 

The committee is responsible to send the decisions to the municipality concerned within three days from the date of the issuance of the decision in a bid to take the necessary action.

As per the law, the committee is led by the director of Doha Municipality and members of the committee will be director of Al Rayan Municipality, Director of Legal Affairs Department, Director of Urban Planning Department, Director of Technical Affairs Department at Doha Municipality, a representative from General Department of Civil Defence at the Ministry of Interior. 

The committee holds two meetings in a month to finalise the requests submitted by the municipalities concerned.

أصدرت لجنة صيانة وهدم المباني بوزارة البلدية والبيئة خلال الربع الثاني من العام الجاري، 140 قراراً ، شملت 115 قرار هدم و 25 قرار صيانة، وتوزعت القرارات بمعدل 54 قرار في أبريل، 40 قرار في مايو ، 46 قراراً في يونيو. وقد تلقت اللجنة خلال تلك الفترة 277 طلباً من البلديات منها 197 طلب هدم و80 طلب صيانة.

وبلغ عدد الطلبات التي تلقتها اللجنة من البلديات منذ تشكيلها 1178 طلب هدم و347 طلب صيانة، حيث قامت اللجنة بعمل اللازم حيالها سواء بإصدار القرارات المناسبة او مخاطبة الجهات المعينة أو بالتوجيه للبلديات بكيفية التعامل حسب الحالة وطبقا للقانون 29 لسنة 2006 بشأن مراقبة المباني، وقد أصدرت اللجنة حتى تاريخه 1110 قراراً.

جدير بالذكر إنه تم تشكيل لجنة (صيانة وهدم المباني) استناداً للمادة رقم (4) من القانون رقم (29) لسنة 2006م بشأن مراقبة  المباني، وبموجب القرار الوزاري رقم 88 لسنة 2006م، والمعدل بالقرار الوزاري رقم 289 لسنة 2017 حيث تختص اللجنة بالمهام التالية:

وتتولى اللجنة دارسة أوضاع المباني الآيلة للسقوط او المطلوب صيانتها التي تُحال اليها من البلدية المختصة، وتقوم بمعاينتها إذا تطلب الامر ، وتُقرر ما يلزم بشأنها من صيانة أو هدم كلي او جزئي، وطبقاً للقواعد والإجراءات والمتطلبات المحددة بالقانون رقم (29) لسنة 2006م .

وتصدر اللجنة القرار المناسب بشأن العقار متضمناً وصف لحالة العقار ، ومدى الخطر الماثل ، وما يمثله هذا الخطر على السكان أو الجيران أو المارة أو المباني المجاورة ، والإجراءات الاولية الواجب اتخاذها من قبل المالك والبلدية المختصة ، وتحيل اللجنة القرارات الصادرة إلى البلدية المختصة خلال مدة لا تتجاوز ثلاثة أيام من تاريخ صدور القرار لاتخاذ ما يلزم.

وتضم اللجنة في عضويتها عدداً من مدراء البلديات والإدارات بالوزارة ، بالإضافة إلى عضوين من خارج الوزارة ، (مدير بلدية الدوحة – مدير بلدية الريان – مدير إدارة الشؤون القانونية – مدير إدارة التخطيط العمراني- مدير ادارة الشؤون الفنية ببلدية الدوحة) وممثل عن الإدارة العامة للدفاع المدني بوزارة الداخلية ، وممثل عن المجلس البلدي المركزي، وتعقد اللجنة اجتماعين في الشهر كحد أدنى للبت في الطلبات الواردة إليها.
