Doha Islamic Finance Conference Calls for Expanding E-Payment Platforms

Doha: Participants in the Seventh Doha Islamic Finance Conference on Wednesday underlined the significance of expanding online payment platforms, following the examples of “Hukoomi Qatar” and “Qatar Airways” websites.

Participants in the second day of the conference also stressed the need to set conditions on e-commerce activities, especially those related to foods, and to further impose oversight by the competent authorities to ensure the safety of consumers and maintain their health, in addition to enacting appropriate penalties for violators of the legislation related to the practice of e-commerce in the country, and launching media campaigns and seminars on various media outlets to introduce the rights and duties of everyone practicing e-commerce in the country.

The session of the second day of the conference discussed the theme “Economies of the Virtual World” upon the emergence of the coronavirus crisis and imposition of social distancing restrictions. The participants reviewed the world’s moving towards safer virtual environments for economic activities, and digital technology companies have benefited from this approach, turning to an accelerated revolution in the field of e-commerce and e-applications, thus forming a model for a significant and promising economy.

The theme reviewed models from the economies of this virtual world through the experiences of the owners of these projects and discussed the most important legal and sharia controls governing the transactions with this world, and then provided a forward-looking vision for the future of this important sector.

The session was moderated by Dr. Nayef Bin-Nahar Al Shammari, Director of the Ibn Khaldun Center for Humanities and Social Sciences at Qatar University.

Professor of Jurisprudence at Qatar University Prof. Dr. Saad-Eddin Dadash highlighted Sharia controls for virtual world economies, stressing the need to tighten Sharia controls on doing business and selling through websites in the country in order to ensure that forbidden transactions are avoided.

He noted the importance of preventing arbitrary conditions accompanying the conclusion of e-commerce contracts, and the importance of issuing a certificate and a registration license for the product accompanied by and electronic signature to avoid the electronic commercial fraud that has been expanding recently.

Speakers in the session included Fahad Al Naimi, Founder and Executive Director of Mzad Qatar; Basil El Haj, a YouTuber and Content Producer from Palestine; Ahmed Ajina from Seddons Solicitors in the UK; and Prof. Dr. Volker Neinhaus, the Emeritus Professor of Economics at the University of Bochum in Germany. The speakers shed light on models from virtual world economies, the governing laws for dealing with the virtual world, and the digital future of the world economy.

The Seventh Doha Islamic Finance Conference is held under the patronage of HE Prime Minister and Minister of Interior Sheikh Khalid bin Khalifa bin Abdulaziz Al-Thani, and is organized by Bait Al-Mashura Finance Consultations in cooperation with the exclusive strategic partner Dukhan Bank.

Titled “Digital Economy and Sustainable Development” is being held virtually in line with the State’s precautionary measures against the coronavirus, with a wide international participation from governmental bodies, organizations, and financial and academic institutions in the fields of economy, money and technology.

وشدد المشاركون في اليوم الثاني للمؤتمر على ضرورة وضع شروط على أنشطة التجارة الإلكترونية، خاصة المتعلقة بالأطعمة والمأكولات، وبمزيد فرض رقابة من قبل الجهات المختصة لضمان سلامة المستهلكين والحفاظ على صحتهم، علاوة على سن عقوبات مناسبة على المخالفين للتشريعات ذات الصلة بممارسة التجارة الإلكترونية في الدولة، بالإضافة إلى القيام بحملات إعلامية وندوات في وسائل الإعلام المختلفة للتعريف بحقوق وواجبات كل من يزاول مهنة التجارة الإلكترونية في البلاد.

وتضمن اليوم الثاني للمؤتمر مناقشة المحور الثاني، وهو اقتصادات العالم الافتراضي مع ظهور أزمة كورونا، وفرض قيود التباعد الاجتماعي، حيث استعرضت جلسات المؤتمر اتجاه العالم نحو بيئات افتراضية أكثر أمانًا لممارسة الأنشطة الاقتصادية وإلى ثورة متسارعة في مجال التجارة والتطبيقات الإلكترونية التي شكلت نموذجًا لاقتصاد مهم وواعد، واستفادة شركات التكنولوجيا الرقمية من هذا المشهد.

وقد استعرض هذا المحور نماذج من اقتصادات هذا العالم الافتراضي من خلال تجارب عاشها أصحاب تلك المشروعات، وناقش أهم الضوابط الشرعية والقانونية الحاكمة للتعامل مع هذا العالم، مقدما رؤية استشرافية لمستقبل هذا القطاع المهم.

وترأس جلسة اقتصادات العالم الافتراضي الدكتور نايف بن نهار الشمري، مدير مركز ابن خلدون للعلوم الإنسانية والاجتماعية في جامعة قطر، بينما استعرض الأستاذ الدكتور سعد الدين دداش، أستاذ الفقه بجامعة قطر، الضوابط الشرعية لاقتصادات العالم الافتراضي، حيث شدد على أهمية قيام المصارف الإسلامية والمؤسسات المالية الإسلامية بتقديم بدائل عن البطاقات غير المغطاة، مع ضرورة التزام إصدارها بالشروط والضوابط الشرعية، وتتجنب شبهات الربا، والذرائع المفضية إليه، كفسخ الدين بالدين.

ولفت إلى ضرورة تشديد الضوابط الشرعية على ممارسة الأعمال التجارية والبيع من خلال المواقع الإلكترونية في الدولة لضمان تجنب المعاملات المحرمة كالربا وغيرها، منوها إلى أهمية منع الشروط التعسفية المصاحبة لإبرام عقود التجارة الالكترونية، مثل الشرط الذي يعفي من مسؤولية العيوب الخفية مع أهمية إصدار شهادة ورخصة تسجيل للمنتج مشفوعة بتوقيع إلكتروني تفاديا للغش التجاري الإلكتروني الذي أخذ يتوسع في الآونة الأخيرة.

أما السيد فهد النعيمي، المؤسس والمدير التنفيذي لـ”مزاد قطر”، فقد سلط الضوء على نماذج لاقتصادات العالم الافتراضي، فيما شارك باسل الحاج وهو صانع محتوى على اليوتيوب من فلسطين، نماذج لاقتصادات العالم الافتراضي، مثلما تناول الشريك في شركة “سيدنس” البريطانية أحمد عجينة القوانين الحاكمة للتعامل مع العالم الافتراضي، بينما قدم الدكتور فولكر نايين هاوس، أستاذ الاقتصاد بجامعة بوخوم الألمانية، رؤية استشرافية لمستقبل اقتصادات العالم الافتراضي.

وينعقد مؤتمر الدوحة السابع للمال الإسلامي تحت عنوان “الاقتصاد الرقمي والتنمية المستدامة” وتنظمه شركة “بيت المشورة” للاستشارات المالية بالتعاون مع الشريك الاستراتيجي والراعي الحصري “بنك دخان” بمشاركة اقليمية ودولية واسعة.

ويقام المؤتمر تحت رعاية معالي الشيخ خالد بن خليفة بن عبدالعزيز آل ثاني، رئيس مجلس الوزراء ووزير الداخلية، بتقنية الاتصال المرئي توافقا مع الإجراءات الاحترازية ضد انتشار فيروس كورونا، وبمشاركة دولية من هيئات حكومية ومنظمات ومؤسسات مالية وأكاديمية في مجالات الاقتصاد والمال والتكنولوجيا.
