New Regulations: Heavy Penalties for Installing Noisy Vehicle Parts

Doha: The Ministry of Commerce and Industry, in collaboration with the Ministry of Interior, has announced a new circular to car and motorcycle dealers, as well as maintenance service providers, stating that the installation of vehicle parts that cause noise is a violation of the law.
According to the circular numbered (3) for the year 2023 regarding “Noise Levels emitted by Cars and Motorcycles,” published by the ministry on its official Twitter account, the violation entails:
A fine of no more than one million riyals or imprisonment for a period not exceeding two years.
Administrative closure for a period not exceeding three months.
The corrective measures that must be taken include:
Ceasing the sale of parts that cause amplified and loud sounds in cars and motorcycles, resulting in noise pollution.
Recalling vehicles that have been installed with “parts that cause amplified and loud sounds” and adjusting their condition by removing parts that violate the standard specifications set in Qatar.
Reconciling the situation: Car and motorcycle dealers, along with their affiliated maintenance centers, as well as all other maintenance centers, will be granted a period ranging from one month to 60 days from the date of issuance of the circular to rectify their situations.
Complying with the provisions and requirements stipulated in Law No. 19 of 2007, amending the Traffic Law, and Law No. 30 of 2002, issuing the amended Environmental Protection Law, which include provisions and conditions that prohibit noise pollution.
In this regard, the ministry affirms that a joint campaign will be launched in cooperation with the Ministry of Interior under the slogan “Noise Pollution from Cars and Motorcycles” within a month from the date of issuing this circular to ensure the compliance of various sales outlets and maintenance centers with the Qatari standard specifications. It emphasizes that it will firmly address anyone who neglects their obligations as stipulated in Law No. 8 of 2008 on Consumer Protection and its executive regulations.
Based on Law No. 8 of 2008 on Consumer Protection and its amendments, which clarified the obligations of suppliers, car and motorcycle dealers, maintenance service providers, and the method of implementing these commitments according to conditions that align with the provisions of the law and its executive regulations, the ministry highlights the necessity of suppliers’ compliance and ensuring that the sound levels emitted by cars and motorcycles are in accordance with the Qatari standard specifications issued by the Qatar General Organization for Standardization.
It should be noted that Qatar applies the following standard specifications:
Gulf Standard Specification (Automobiles – Noise Pollution) within the mechanical products specifications sector.
Gulf Standard Specification (Motorcycles – Noise Pollution) within the mechanical products specifications sector.
Therefore, the sound level in the car or motorcycle should not exceed the limits specified by the specification in decibels (dB) when the vehicle is tested while in motion, regardless of whether it has a gasoline or diesel engine. Violating the specified levels constitutes a clear violation of the provisions of Articles (5), (6), and (13) of Law No. 8 of 2008 on Consumer Protection.

الدوحة: أعلنت وزارة التجارة والصناعة، بالتعاون مع وزارة الداخلية، في تعميم جديد، لوكلاء السيارات والدراجات النارية ومقدمي خدمات الصيانة، أن تركيب قطع غيار تسبب ضوضاء المركبات يعد مخالفة للقانون .
ووفق التعميم الذي حمل رقم (3) لسنة 2023 بشأن “مستوى الضوضاء الصادر عن السيارات والدراجات النارية”، ونشرته الوزارة على حسابها الرسمي بموقع تويتر، فإن مخالفة التعميم:
1- غرامة لا تزيد عن المليون ريال أو الحبس لمده لا تتجاوز السنتين
2- إغلاق إداري لمده لا تزيد عن ثلاثة شهور
والإجراءات التصحيحية الواجب اتخاذها:
1- وقف بيع قطع الغيار المسببة لتضخيم وتكبير الصوت في السيارات والدراجات النارية والتي ينتج عنها تلوث ضوضائي.
2- استدعاء السيارات التي تم تركيب “قطع الغيار المسببة لتضخيم وتكبير الصوت” لها وتعديل وتصويب وضعها وذلك بإزالة قطع الغيار المخالفة للمواصفات القياسية المقررة بدولة قطر.
3- توفيق الأوضاع: حيث سيتم منح وكلاء السيارات والدراجات النارية، ومراكز الصيانة التابعة لها بالإضافة إلى جميع مراكز الصيانة الأخرى مهلة تتراوح من شهر إلى 60 يوماً من تاريخ صدور التعميم؛ لتصويب أوضاعها.
4- مراعاة ما تطلبه مرسوم بقانون رقم (19) لسنة 2007 بإصدار قانون المرور المعدل ومرسوم بقانون رقم (30) لسنة 2002 بإصدار قانون حماية البيئة المعدل، من أحكام واشتراطات تمنع وجود التلوث الضوضائي.
وفي هذا الصدد تؤكد الوزارة أنه سيتم إطلاق حملة مشتركة، بالتعاون مع وزارة الداخلية تحت شعار”التلوث الضوضائي الناتج عن السيارات والدراجات النارية” وذلك خلال شهر من تاريخ إصدار هذا التعميم للتأكد من مدى التزام مختلف منافذ البيع ومراكز الصيانة؛ باشتراطات المواصفات القياسية القطرية المقررة. وأنها ستواجه بحزم كل من يتهاون في القيام بالتزاماته المنصوص عليها في القانون رقم 8 لسنة 2008 بشأن حماية المستهلك ولائحته التنفيذية.
واستناداً إلى القانون رقم (8) لسنة 2008 بشأن حماية المستهلك وتعديلاته الذي أوضح التزامات المزودين ووكلاء السيارات والدراجات النارية ومقدمي خدمات الصيانة وبيان كيفية تنفيذ هذه الالتزمات وفق الشروط التي تتماشى مع أحكام القانون ولائحته التنفيذية، تنوه الوزارة بضرورة التزام المزودين وتأكدهم من مطابقة مستويات الصوت الصادرة عن السيارات والدراجات النارية مع شروط ومعايير المواصفات القياسية القطرية المقررة والصادرة عن الهيئة العامة القطرية للمواصفات والتقييس.علمًا أن دولة قطر تُطبق المواصفات القياسية التالية:
(1) المواصفة القياسية الخليجية (السيارات- التلوث الضوضائي) ضمن قطاع مواصفات المنتجات الميكانيكية.
(2) المواصفة القياسية الخليجية (الدراجات النارية.- التلوث الضوضائي) ضمن قطاع مواصفات المنتجات الميكانيكية.
وعليه ينبغي ألا يتعدى مستوى الصوت في السيارة أو الدراجة النارية الحدود الموضحة بالمواصفة لوحدة ال (ديسيبل)؛ سواء لذات محرك البنزين أو الديزل عندما تُختبر السيارة وهي متحركة. علمًا أن مخالفة المستويات المقررة يُعد مخالفة صريحة لأحكام المواد (5) و(6) و(13) من القانون رقم (8) لسنة 2008 بشأن حماية المستهلك.
