Learner driver commits a car accident, driving education company pays the price

Doha: A driving education company lost a lawsuit to the judiciary over a road accident committed by a learner who was driving a training car without a driving instructor and injured a person, and the court imposed in the preliminary ruling insurance coverage for the vehicle and injury indemnity for the victim.
The company filed its case with the Court of Cassation, which ruled that the matter was dismissed because the company was responsible for the insurance coverage of the driving training vehicle and belonged to it.
According to the facts, the appellee who is a learner drove a training car under education, committed a road accident and injured a person, and the appellant is the driving education company in charge of covering the accidents, in addition to the loss of his right to insurance coverage because the accused violated the traffic law by driving a car without a full license and without a driving instructor at his side on an unspecified training road and that the company is the concerned.
According to the preliminary ruling, the company responsible for driving demanded that the right to insurance coverage be dropped, that the insurance covering the incident is a driver’s license under exercise coverage and estimated the deficit rate at 45% of the full body ratio and concluded that the element of fault is attributed to the accused which resulted in injury to the victim and ended up punishing him and obliged the company to injury indemnity and that the car in which the accident was committed is insured against others and he must reject the appeal.
The ruling determined the car role in the event, as responsible for covering the accident in accordance with the legal provisions of traffic and before the Court of Cassation, the case was dismissed because the appeal filed by the company and its lack of responsibility for the incident and the insurance coverage were bad governance.

الدوحة: خسرت شركة تعليم قيادة دعوى أمام القضاء بسبب حادث طريق ارتكبه متدرب كان يقود سيارة تعليم بدون معلم قيادة وتسبب في إصابة شخص، وفرضت المحكمة في الحكم الابتدائي تغطية تأمينية للمركبة وإرش إصابة للمتضرر.
وتقدمت الشركة بدعواها أمام محكمة التمييز التي قضت برفض الموضوع لكون الشركة هي المسؤولة عن التغطية التأمينية لمركبة التدريب على القيادة وهي تتبع لها.
تفيد الوقائع أنّ متدرباً وهو المطعون ضده ساق سيارة تدريب تحت التعليم، وارتكب حادث طريق وأصاب شخصاً، والطاعنة هي الشركة المعنية بتعليم القيادة محل الدعوى المسؤولة عن تغطية الحوادث، بالإضافة إلى سقوط حقه في التغطية التأمينية لكون المتهم خالف قانون المرور بقيادة سيارة بدون رخصة كاملة وبدون تواجد معلم قيادة إلى جانبه على طريق غير محددة للتدريب وأنّ الشركة هي المعنية.
وجاء في الحكم الابتدائي أنّ الشركة المسؤولة عن القيادة طالبت بإسقاط الحق في التغطية التأمينية وأنّ التأمين الذي يغطي الحادث هو تأمين رخصة قيادة تحت التمرين وقدرت نسبة العجز بـ 45 % من نسبة الجسم الكامل وخلص الحكم إلى توافر ركن الخطأ الذي نسب إلى المتهم ونشأ عنه إصابة المجني عليه وانتهى إلى معاقبته وألزمت الشركة بإرش إصابة وأنّ السيارة التي ارتكب بها الحادث مؤمن عليها ضد الغير ويتعين منه رفض الاستئناف.
وكان الحكم قد قضى بدور السيارة في الحدث وهي المتسببة وهي المسؤولة عن تغطية الحادث وفق المواد القانونية للمرور وأمام محكمة التمييز تمّ رفض الموضوع لكون الطعن المقدم من الشركة وعدم مسؤوليتها عن الحادث وعن التغطية التأمينية غير سديد.
