NHRC urges 3 UN bodies to lift Saudi obstacles to Qatar’s pilgrims

Doha: The National Human Rights Committee (NHRC) has expressed concern about the continued obstructions and obstacles imposed by the Saudi authorities which are not taking any positive step to enable Qatari citizens and residents to exercise their right to perform their religious rituals.
This came in letters sent by Chairman of the National Human Rights Committee, Dr Ali bin Smaikh Al Marri, to three United Nations bodies, asking them to take immediate action against the Saudi authorities so that the pilgrims of the State of Qatar could to perform Haj like all Muslims.
The letters were sent to President of the Human Rights Council Vojislav Suc, the UN High Commissioner for Human Rights Prince Zeid bin Raad and Special Rapporteur on Freedom of Religion or Belief Ahmed Shaheed.
Dr. Al Marri noted that the NHRC is studying all legal procedures to prosecute the Kingdom of Saudi Arabia for its flagrant violations of the right to practice religious rites as well as continuing the politicisation of Hajj and Umrah and its procrastination in raising obstacles to Qatar’s pilgrims, stressing that the Saudi authorities is practicing the policy of escaping forward through misleading statements and sham proceedings they take in order to mislead the international community and avoid international condemnation.
He warned that the authorities in Saudi Arabia can not deceive the international organizations and the international community, and they bear responsibility for depriving the pilgrims of Qatar from the second season, affirming that the National Human Rights Committee will spare no effort to hold them accountable in all international forums.
Al Marri noted that the major international organizations, including the United Nations, Amnesty International and Human Rights Watch, have condemned in their reports and statements the practices of the Saudi authorities and their flagrant violations of the right to practice religious rites. The letters explained that the obstacles deliberately put by the Saudi authorities in front of those wishing to perform Hajj from Qatar’s citizens and residents constitute a grave violation of the right to worship and to practice the religious rituals stipulated in the international and regional human rights conventions.
The letters also confirmed that with the advent of the Hajj season, the ban on direct flights from the State of Qatar to Saudi Arabia continues, as well as the closure of the border land port between the two countries, the non-admission of pilgrims and the closure of the electronic track for the registration of pilgrims.
The Saudi Authorities also prevent financial transfers between the Qatari campaigns and the Saudi Hajj agents who are authorized to grant the necessary permits, in addition to preventing the circulation of the Qatari currency in the Kingdom and the failure of the Saudi authorities to take account of the damage caused to the owners of the Qatari Hajj campaigns and companies and the financial losses resulting from these arbitrary measures.
The letters indicated that, in the response of the Permanent Delegation of the Kingdom of Saudi Arabia to the United Nations in Geneva, “they repeat the same conditions that were previously announced, which were vague and unclear, and did not include any new with regard to the removal of obstacles and difficulties for pilgrims from Qatar, in addition, the Saudi response did not answer to what was included by the National Human Rights Committee in its reports on the damage and financial losses incurred by the Qatari Hajj campaigns. The Committee said in the letters that it considers the procrastination in the Hajj issue as an attempt by the authorities in Saudi Arabia to stop any action that can be taken by the Office of the High Commissioner for Human Rights or any other measures.
The Committee stressed the need to take necessary action with the responsible authorities in Saudi Arabia in order to immediately lift the restrictions and obstacles referred to, through the agreement with the Ministry of Awqaf and Islamic Affairs in Qatar on clear and specific mechanisms to facilitate Hajj procedures for Qatar’s citizens and residents, opening the electronic registration of pilgrims from Qatar and granting them visas through the Embassy of the Sultanate of Oman in Doha, in addition to opening the border land port between the two countries to take account of humanitarian cases, and residents of low income, as well as the opening of direct airlines from Qatar to Saudi Arabia and vice versa, allowing financial transfers between the campaigns and the Qatari Hajj companies and Saudi Hajj agents, and allowing the circulation of the Qatari currency in Saudi Arabia.
The NHRC letters added that the delegation of the Ministry of Awqaf and Islamic Affairs in the State of Qatar visited Saudi Arabia and met with the competent authorities there to discuss the lifting of obstacles and difficulties faced by Qatar’s pilgrims and the need to take into account the vulnerable groups, especially the elderly, persons with disabilities and low income people, however, the Qatari delegation did not find any solutions to these obstacles from the Saudi side, which responded only by saying that the Ministry of Awqaf and Islamic Affairs in Qatar should address official requests through the Embassy of the Sultanate of Oman in order to submit these requests to the higher authorities in the Kingdom to decide whether or not to respond.
The letters said that the State of Qatar, represented by the Ministry of Awqaf and Islamic Affairs, has responded to that request and sent the official letters immediately, but there was no answer so far, although the pilgrimage season is approaching and the pilgrims should begin Hajj arrangements so that they can perform their religious rituals in due course. NHRC referred to the statement of Qatar’s Ministry of Awqaf and Islamic Affairs on June 6 which affirmed that the Saudi authorities continue to impose obstacles and arbitrary measures that single out those living in Qatar in particular out of the rest of the Muslim world, and that the border land port is still closed completely while direct air travel from Doha to Jeddah was also unavailable.
بعث سعادة الدكتور علي بن صميخ المري رئيس اللجنة الوطنية لحقوق الإنسان بخطابات لثلاث جهات بالأمم المتحدة شملت السيد فوجيسلاف سوك، رئيس مجلس حقوق الإنسان، والأمير زيد بن رعد المفوض السامي لحقوق الإنسان والسيد أحمد شهيد المقرر الخاص المعني بحرية الدين أو المعتقد معرباً عن قلق اللجنة الوطنية لحقوق الإنسان حيال استمرار العراقيل والمعوقات وعدم اتخاذ السلطات السعودية أية خطوات إيجابية من شأنها تمكين المواطنين القطريين والمقيمين في دولة قطر من ممارسة حقهم في أداء شعائرهم الدينية ومطالباً إياهم باتخاذ إجراءات فورية ضد السلطات السعودية حتى يتمكن حجاج دولة قطر من أداء مناسك فريضة الحج كسائر المسلمين.
لافتاً إلى أن اللجنة الوطنية لحقوق الإنسان بدولة قطر بصدد دراسة كافة الإجراءات القانونية لمقاضاة المملكة العربية السعودية بسبب انتهاكاتها الصارخة للحق في ممارسة الشعائر الدينية إلى جانب الاستمرار في فضح تسييس الحج والعمرة وممطلاتها في رفع المعوقات التي تضعها أمام حجاج دولة قطر. مؤكدا أن السلطات السعودية تُمارس سياسة الهروب إلى الأمام من خلال بيانات التضليل التي تصدرها والإجراءات الصورية التي تتخذها بغرض تضليل المجتمع الدولي وتفادي الإدانة الدولية.
وقال: إن السلطات في المملكة لا يمكنها مخادعة المنظمات الدولية والمجتمع الدولي وهي تتحمل مسؤولية ضياع الموسم الثاني لحجاج دولة قطر وأن اللجنة الوطنية لحقوق الإنسان لن تألو جهداً في طرح عملية محاسبتها ومساءلتها في كافة المحافل الدولية. منوهاً في الوقت ذاته إلى أن كبريات المنظمات الدولية منها الأمم المتحدة والعفو الدولية وهيومن رايتس أدانت في تقاريرها وبياناتها ممارسات السعودية وانتهاكاتها الصارخة للحق في ممارسة الشعائر الدينية.
وأوضحت حيثيات الرسائل للجهات الثلاث، أن المعوقات التي تتعمد وضعها السلطات السعودية أمام الراغبين في أداء مناسك الحج من المواطنين القطريين والمقيمين على أرض دولة قطر، يمثل انتهاكاً جسيماً للحق في العبادة وممارسة الشعائر الدينية المنصوص عليها في الاتفاقيات الدولية و الإقليمية لحقوق الإنسان.
وأكدت رسائل اللجنة الوطنية لحقوق الإنسان في الوقت ذاته أنه مع حلول موسم الحج ما زال حظر الطيران المباشر من دولة قطر إلى المملكة العربية السعودية مازال مستمراً، إلى جانب استمرار غلق المنفذ البري الحدودي بين البلدين وعدم السماح بدخول الحجاج منه، واستمرار إغلاق المسار الإلكتروني الخاص بتسجيل الحجاج، بالإضافة إلى منع التحويلات المالية من قبل السلطات في المملكة العربية السعودية بين الحملات القطرية ووكلاء الحج السعوديين المخولين بمنح التصاريح اللازمة لذلك ، علاوة على منع تداول العملة القطرية في المملكة العربية السعودية، فضلاً عن عدم مراعاة السلطات السعودية لما لحق أصحاب الحملات وشركات الحج القطرية ، من أضرار وخسائر مالية جراء الإجراءات التعسفية المشار إليها.
واعتبرت الخطابات أنه من خلال ما جاء في رد الوفد الدائم للمملكة العربية السعودية لدى الأمم المتحدة في جنيف، فإنهم يعيدون ذات الشروط التي تم الإعلان عنها سابقاً، والتي جاءت مبهمة وغير واضحة ولم تحمل أي جديد فيما يخص إزالة المعوقات والصعوبات أمام الحجاج من دولة فضلاً عن أن الخطاب المذكور خلا من الإجابة على ما سبق وأدرجته اللجنة الوطنية لحقوق الإنسان بدولة قطر في تقاريرها بشأن الأضرار والخسائر المالية التي لحقت حملات الحج القطرية .
تسويف ومماطلة
وقالت اللجنة في مخاطباتها: إننا نعتبر إطالة موضوع الحج وتسويف هذه القضية هو محاولة من السلطات بالمملكة العربية السعودية لإيقاف أية إجراءات يمكن أن تتخذها المفوضية السامية لحقوق الإنسان أو الإجراءات الخاصة. وشددت على ضرورة اتخاذ اللازم مع الجهات المسؤولة في المملكة العربية السعودية من أجل رفع القيود والمعوقات المشار إليها فوراً وذلك عن طريق الاتفاق مع وزارة الأوقاف والشؤون الإسلامية القطرية على آليات واضحة ومحددة لتسهيل إجراءات الحج أمام المواطنين القطريين والمقيمين بدولة قطر . وفتح المسار الالكتروني الخاص بتسجيل الحجاج من دولة قطر ، ومنحهم التأشيرات عن طريق سفارة سلطنة عمان بالدوحة. بالإضافة إلى فتح المنفذ البري الحدودي بين البلدين مراعاة لأصحاب الحالات الإنسانية، والمقيمين من ذوي الدخل المحدود. وفتح خطوط الطيران المباشر من دولة قطر إلى المملكة العربية السعودية والعكس أمام راغبي الحج. إلى جانب السماح بالتحويلات المالية بين الحملات وشركات الحج القطرية ووكلاء الحج السعوديين ، والسماح بتداول العملة القطرية في المملكة العربية السعودية.
معوقات وعراقيل
ولفتت خطابات اللجنة إلى أن وفد وزارة الأوقاف والشؤون الإسلامية بدولة قطر زار المملكة العربية السعودية واجتمع مع الجهات المختصة في المملكة العربية السعودية لمناقشة رفع المعوقات والصعوبات أمام الحجاج القطريين والمقيمين بدولة قطر، وضرورة مراعاة الحجاج للفئات الضعيفة لاسيما كبار السن والأشخاص ذوي الإعاقة ومحدودي الدخل، وقالت: إنّ الوفد القطري لم يجد أي حلول لهذه المعوقات والعراقيل من جانب السلطات السعودية المعنية ، التي اكتفت بالرد على الوفد القطري بأن على وزارة الأوقاف والشؤون الإسلامية بدولة قطر توجيه مخاطبات رسمية بمطالبها عن طريق سفارة سلطنة عمان لعرضها على الجهات العليا بالمملكة العربية السعودية لتقرر ما إذا كان سيتم الاستجابة لها من عدمه.
لا ردود سعودية
وأوضحت الرسائل أن دولة قطر ممثلة بوزارة الأوقاف والشؤون الإسلامية قامت بتنفيذ ماطالبته الجهات المختصة في المملكة العربية السعودية وتمت المخاطبات في حينها ولم يتم الرد حتى الآن. وأشارت إلى أنه بالرغم من أن موسم الحج في اليوم الثامن من شهر ذي الحجة الموافق 20 أغسطس 2018، ووفقاً لماهو معلوم أنه على الحجاج أن يبدأوا من الآن بترتيبات الحج ليتمكنوا من القيام بشعائرهم الدينية بالوقت المناسب. إلا أن وزارة الأوقاف والشئون الإسلامية بدولة قطر أكدت في بيان لها في السادس من يونيو الماضي أن “استمرار العراقيل والإجراءات التعسفية التي تفرضها المملكة على قاطني دولة قطر جملة ودون غيرهم من مسلمي العالم”. وأنّ باب العمرة والحج عن طريق البر لا زال مغلقا تماما، والتوجه من مدينة الدوحة إلى مدينة جدة مباشرة أيضا غير متاح.
