MEC shuts down clothing store over counterfeit trademarks

The Ministry of Economy and Commerce (MEC) has announced a three-week closure of a clothing store in Al Sadd for displaying and selling counterfeit menswear bearing international trademarks.

The inspection campaign comes within the framework of the ministry’s efforts to monitor markets and commercial activities in order to crack down on violations, price manipulation and counterfeit and substandard products.

The company was fined and closed for three weeks in line with Article 7 of Law No 8 of 2008, the MEC said in a press statement on Sunday.

Article 7 compels suppliers to clearly display on the product’s package or label the type and nature of the item as well as other relevant data. The law also prohibits the display of fraudulent descriptions, advertisements and misleading statements.

The administrative closure declaration shall be published at the expense of the company or shop that committed the violation in accordance with Article 18 of Law No 8 on Consumer Protection.

The law stipulates that the closure decision shall be published on the MEC’s website and in two daily newspapers at the expense of the company.

The ministry stressed that it will not tolerate any violations of Consumer Protection Law and its regulations. It will refer those who violate laws and ministerial decrees to the competent authorities, who will, in turn, take appropriate action against the perpetrators in order to protect consumer rights.

أعلنت وزارة الاقتصاد والتجارة عن إغلاق محل للملابس الجاهزة في منطقة السد لمدة 3 أسابيع، إثر قيامه بعرض وبيع ملابس رجالية مقلدة عن علامات تجارية عالمية.

جاء ذلك في إطار الحملات التفتيشية المكثفة التي تنفذها وزارة الاقتصاد والتجارة لمراقبة الأسواق والأنشطة التجارية في الدولة، بهدف ضبط الأسعار، والكشف عن التجاوزات والسلع المغشوشة والمقلدة وغير المطابقة للمواصفات القياسية.

التزام

وجرى تحرير مخالفة وإغلاق المحل لمدة 3 أسابيع، وذلك لمخالفته المادة رقم 7 من القانون رقم 8 لسنة 2008، والتي تنص على «أن يلتزم المزود لدى عرض أي سلعة للتداول أن يبين على غلافها أو عبوتها وبشكل واضح نوع السلعة وطبيعتها ومكوناتها، وكافة البيانات المتعلقة بها، ويحظر على المزود وصف السلعة أو الإعلان عنها أو عرضها بأسلوب يحتوي على بيانات كاذبة أو خادعة».

ويُنشر إعلان الإغلاق الإداري على نفقة الشركة أو المحل المخالف، وفقاً للمادة رقم 18 مكرر من القانون رقم 8 بشأن حماية المستهلك، والتي تنص على أن يُنشر هذا القرار على الموقع الإلكتروني للوزارة وفي صحيفتين يوميتين على نفقة الشركة المخالفة.

وأكدت الوزارة أنها ستكون حازمة في وجه كل من يتهاون في القيام بالتزاماته بقانون حماية المستهلك ولائحته التنفيذية، وستكثف حملاتها التفتيشية لضبط مثل هذه الممارسات، وستحيل كل من يخالف القوانين والقرارات الوزارية المنظمة لعمل الإدارة إلى الجهات المختصة لاتخاذ الإجراءات المناسبة ضده، وذلك حماية لحقوق المستهلكين.;
