Doha: HE Prime Minister and Minister of Interior Sheikh Khalid bin Khalifa bin Abdulaziz Al-Thani chaired the Cabinet’s regular meeting held at its seat at the Amiri Diwan on Wednesday.
Following the meeting, HE Minister of Justice and Acting Minister of State for Cabinet Affairs Dr. Issa bin Saad Al Jafali Al Nuaimi issued the following statement:
At the beginning of the meeting, the Cabinet was briefed by HE Minister of Public Health on the latest developments in efforts to curb Coronavirus (COVID-19). The Cabinet affirmed the continuation of work with the precautionary measures taken to combat the pandemic.
Then, the cabinet considered the topics on the agenda as follows:
First, Approval of the draft law on combating conflicts of interest and referring it to the Shura Council.
The draft law included, among its provisions, defining the employee as every person who occupies a position or a job, whether permanently or temporarily, in one of the bodies to which the provisions of this law apply, and whoever is entrusted by the court to carry out a mission of arbitrators, experts and bankruptcy administrators, liquidators and judicial guards, as the case may be.
The definition of a conflict of interest is any situation in which an employee or a person associated with him has a material or moral interest that conflicts or is likely to conflict with the duties or responsibilities of his position or job, including his commitment to integrity, impartiality, and the preservation of public money and the public interest.
And the preventive measures that the employee must, according to the provisions of the draft law, disclose cases that may lead to a conflict of interest when occupying the position or position, by completing the disclosure form prepared for this purpose, and submitting it to the department or unit concerned with legal affairs or its representative in the entity to which it belongs.
Undersecretaries of the Ministry and those of their ranks shall submit the aforementioned disclosure form to the ministers they report to. Ministers and those of their ranks shall submit the aforementioned disclosure form to the Prime Minister.
Cases of conflict of interest where the employee is prohibited from doing any act or behavior, or making a decision, related to an act of his job or position, or abstaining from it, if it constitutes or results in a conflict of interest.
And mechanisms to combat conflict of interest, where the employee must, in the event of any conflict of interest, disclose it immediately, and prevent any harm to the public interest, and in this he may waive the interest that results in the conflict or leave the position or public position he occupies.
The employee may be dismissed, transferred or suspended from work, as the case may be.
Second, Approval of draft law regulating unmanned aircraft.
The draft law has been prepared to regulate all activities related to drones in order to maintain the security and safety of air navigation in the country, protect lives and property, ensure the optimal use of these aircraft, in accordance with the best international standards and practices, reduce risks arising from the operation of drones, and define the responsibilities of the concerned authorities in this regard, and the regulation of the use of drones by various authorities.
Third – Approval of a draft Amiri decision to establish Doha University for Science and Technology.
The university aims to provide the state with specialists, technicians and experts, by preparing specialized cadres, with university qualifications of all degrees, trained academically, applied, technical and professional in areas that meet the needs of society, government agencies, institutions and various sectors, in order to achieve the goals of human, social and economic development in the state, and to achieve its objectives, the university shall approve and grant the appropriate university degrees and certificates in accordance with the provisions of this resolution.
Fourth – Approval of a draft decision of the Minister of Interior defining the medical examination and the rules and levels of medical fitness for members of private security services companies.
The draft decision was prepared within the framework of issuing executive decisions for the provisions of Law No 19 of 2009 Regulating the Provision of Private Security Services 19 / 2009.
Fifth – Approval of the participation of the National Tourism Council in:
– United States Tour Operators Association (USTOA).
– The Australian Federation of Travel Agents Limited (AFTA).
Sixth – The Council of Ministers reviewed the following two issues and took the appropriate decision:
1- 6th annual report on the results of the work of the National Explosives Commission for the period from Dec.1 – 31, 2020.
2- Report (49)on the results of the work of the National Committee for the Prohibition of Weapons during the period from August 1 – 30, 2021.

الدوحة: ترأس معالي الشيخ خالد بن خليفة بن عبدالعزيز آل ثاني، رئيس مجلس الوزراء ووزير الداخلية ، الاجتماع العادي الذي عقده المجلس يوم الأمس بمقره في الديوان الأميري.
وعقب الاجتماع، أدلى سعادة الدكتور عيسى بن سعد الجفالي النعيمي، وزير العدل والقائم بأعمال وزير الدولة لشؤون مجلس الوزراء بما يلي:
في بداية الاجتماع استمع المجلس إلى الشرح الذي قدمه سعادة وزير الصحة العامة حول آخر المستجدات والتطورات للحد من انتشار فيروس كورونا /كوفيد-19/، وأكد المجلس على استمرار العمل بما تم اتخاذه من إجراءات وتدابير احترازية في سبيل مكافحة هذا الوباء.
وبعد ذلك نظر مجلس الوزراء في الموضوعات المدرجة على جدول الأعمال على النحو التالي :
أولا – الموافقة على مشروع قانون مكافحة تضارب المصالح، وعلى إحالته إلى مجلس الشورى.
وقد تضمن مشروع القانون، من بين أحكامه، تعريف الموظف بأنه كل شخص يشغل أحد المناصب أو الوظائف، سواء كان ذلك بصفة دائمة أو مؤقتة، في إحدى الجهات التي تسري عليها أحكام هذا القانون، وكل من عهدت إليه المحكمة القيام بمأمورية من المحكمين والخبراء ومديري التفليسة والمصفين والحراس القضائيين، بحسب الأحوال.
وتعريف تضارب المصالح بأنها أي حالة يكون فيها للموظف أو للشخص المرتبط به مصلحة مادية أو معنوية تتضارب أو يحتمل أن تتضارب مع واجبات أو مسؤوليات منصبه أو وظيفته، بما في ذلك التزامه بالنزاهة والحيادية والحفاظ على المال العام والمصلحة العامة.
والتدابير الوقائية التي يتعين على الموظف، بموجب أحكام مشروع القانون، الإفصاح عن الحالات التي قد تُفضي إلى تضارب المصالح عند شغلة للمنصب أو الوظيفة، باستيفاء نموذج الإفصاح المعد لهذا الغرض، وتقديمه إلى الإدارة أو الوحدة المختصة بالشؤون القانونية أو من يقوم مقامها في الجهة التابع لها.
ويقدم وكلاء الوزارة ومن في درجاتهم نموذج الإفصاح المشار إليه إلى الوزراء الذين يتبعونهم. ويقدم الوزراء ومن في درجاتهم نموذج الإفصاح المشار إليه، إلى رئيس مجلس الوزراء.
وحالات تضارب المصالح حيث يُحظر على الموظف القيام بأي فعل أو تصرف، أو اتخاذ قرار، يتعلق بعمل من أعمال وظيفته أو منصبه أو الامتناع عنه، إذا شكل أو ترتب عليه تضارب المصالح.
وآليات مكافحة تضارب المصالح حيث يتعين على الموظف، في حال قيام أي حالة تضارب مصالح، الإفصاح عنها فورا، والحيلولة دون وقوع أي ضرر بالمصلحة العامة ، وله في ذلك التنازل عن المصلحة التي يترتب عليها التضارب أو ترك المنصب أو الوظيفة العامة التي يشغلها.
ويجوز تنحية الموظف أو نقله أو وقفه عن العمل، بحسب الأحوال.
ثانيا – الموافقة على مشروع قانون بتنظيم الطائرات بدون طيار.
وقد تم إعداد مشروع القانون لتنظيم كافة الأنشطة الخاصة بالطائرات بدون طيار بغرض المُحافظة على أمن وسلامة الملاحة الجوية في الدولة، وحماية الأرواح والممتلكات، وضمان الاستخدام الأمثل لهذه الطائرات، وفقاً لأفضل المعايير والممارسات العالمية، والحد من المخاطر الناجمة عن تشغيل الطائرات بدون طيار، وتحديد مهام ومسؤوليات الجهات المعنيّة في هذا الشأن، وتنظيم استخدام الجهات المختلفة للطائرات بدون طيار.
ثالثا – الموافقة على مشروع قرار أميري بإنشاء جامعة الدوحة للعلوم والتكنولوجيا.
وتهدف الجامعة إلى تزويد الدولة بالمتخصصين والفنيين والخبراء، عن طريق إعداد وتخريج كوادر متخصصة، من حملة المؤهلات الجامعية بكافة درجاتها، مدربة تدريباً أكاديمياً تطبيقياً وتقنياً ومهنياً في المجالات التي تفي باحتياجات المجتمع والجهات والمؤسسات الحكومية والقطاعات المختلفة، بما يحقق أهداف التنمية البشرية والاجتماعية والاقتصادية في الدولة ويكون للجامعة في سبيل تحقيق أهدافها إقرار ومنح الدرجات والشهادات الجامعية المناسبة المقررة وفقا لأحكام هذا القرار.
رابعا – الموافقة على مشروع قرار وزير الداخلية بتحديد الفحص الطبي وقواعد ومستويات اللياقة الطبية لأفراد شركات الخدمات الأمنية الخاصة.
وقد تم إعداد مشروع القرار في إطار إصدار القرارات التنفيذية لأحكام القانون رقم /19/ لسنة 2009 بتنظيم مزاولة الخدمات الأمنية الخاصة.
خامسا – الموافقة على مشاركة المجلس الوطني للسياحة في كل من :
– رابطة منظمي الرحلات السياحية في الولايات المتحدة الأمريكية.
– رابطة وكلاء سوق السفر في أستراليا.
سادسا – استعرض مجلس الوزراء الموضوعين التاليين واتخذ بشأنهما القرار المناسب :
1 – التقرير السنوي السادس بنتائج أعمال اللجنة الوطنية لشؤون المتفجرات خلال الفترة من 1/1 إلى 31 /12/ 2020 .
2- التقرير /49/ بنتائج أعمال اللجنة الوطنية لحظر الأسلحة خلال الفترة من 1/1 إلى 30 /4/ 2021.
