Qatar Airways launches multibillion-dollar arbitrations

Qatar Airways Group, owner and operator of Qatar Airways, has launched four international investment arbitrations against the United Arab Emirates, the Kingdom of Bahrain, the Kingdom of Saudi Arabia, and the Arab Republic of Egypt. Since 2017, these four states have imposed an illegal air, sea and land blockade against Qatar. The arbitrations seek redress for the blockading states’ actions to remove Qatar Airways from their markets and to forbid the airline from flying over their airspace. Qatar Airways is seeking a total of at least US$5 billion from the blockading states as compensation for their unlawful actions.

“For three decades, Qatar Airways made substantial investments in the four blockading countries in order to serve hundreds of thousands of passengers and to transport tens of thousands of tons of cargo to and from each of these countries annually, a statement from the airline said.

“Starting on June 5, 2017, without prior warning, the UAE, Bahrain, Saudi Arabia and Egypt took collective measures targeting Qatar Airways and its operations. These measures specifically targeted Qatar Airways, with the objective of shuttering Qatar Airways’ local operations, destroying the value of the airline’s investments and causing widespread damage to Qatar Airways’ global network of operations. In particular, these measures included, but were not limited to, closing their airspace and airports to Qatar Airways’ aircraft and revoking Qatar Airways’ licenses and permits to operate in the blockading states. These measures persist to date and continue to disrupt Qatar Airways’ global operations,” it added.

Qatar Airways is seeking full compensation for these damages in four investment arbitrations, brought under three separate treaties, namely: the OIC Investment Agreement; the Arab Investment Agreement; and the bilateral investment treaty between the State of Qatar and Egypt. The Notices of Arbitration make clear that by imposing the measures against Qatar Airways, the blockading states have violated their obligations under the agreements, including by expropriating and failing to adequately protect and secure Qatar Airways’ investments, discriminating against Qatar Airways, and failing to provide fair and equitable treatment to the airline and its investments.

Commenting on the launch of the investment arbitrations, Akbar Al Baker, Group CEO of Qatar Airways, said: “The decision by the blockading states to prevent Qatar Airways from operating in their countries and flying over their airspace is a clear breach of civil aviation conventions and several binding agreements they are signatories to. After more than three years of efforts to resolve the crisis amicably through dialogue yielded no results, we have taken the decision to issue Notices of Arbitration and pursue all legal remedies to protect our rights and secure full compensation for the violations. The blockading states must be held accountable for their illegal actions in the aviation sector, which includes a failure to comply with their obligations under bilateral agreements, multilateral agreements and international law.

Despite the efforts of the blockading states, we have maintained our global position and will continue to promote air travel as a right for all.”

تقدمت “مجموعة الخطوط الجوية القطرية”، المالك والمشغل لشركة الخطوط الجوية القطرية – الناقلة الوطنية لدولة قطر الحائزة على العديد من الجوائز العالمية، بأربعة طلبات للتحكيم الدولي في منازعات الاستثمار ضد كل من الإمارات العربية المتحدة ومملكة البحرين والمملكة العربية السعودية وجمهورية مصر العربية. ومنذ عام 2017، فرضت الدول المذكورة آنفاً حصاراً جوياً وبرياً وبحرياً بشكل غير قانوني على دولة قطر. وتهدف طلبات التحكيم إلى تعويض الخطوط الجوية القطرية عن قيام دول الحصار الأربع بإيقاف عمليات الناقلة في أسواقها، ومنعها من التحليق في مجالها الجوي. وتسعى الخطوط الجوية القطرية إلى الحصول على تعويض بقيمة 5 مليار دولار أمريكي على الأقل من دول الحصار عن ما بدر منها من أفعال غير مشروعة.

وعلى مدار ثلاثة عقود، استثمرت الخطوط الجوية القطرية بشكل كبير في أسواق دول الحصار الأربع، من أجل خدمة مئات الآلاف من المسافرين من هذه الدول، ونقل عشرات آلاف الأطنان من البضائع جواً من وإلى هذه الدول سنوياً.

في 5 يونيو من عام 2017 وبدون سابق إنذار، اتخذت دول الإمارات والبحرين والسعودية ومصر إجراءات مشتركة بقصد إلحاق الضرر عمداً بالخطوط الجوية القطرية وعملياتها. وهدفت هذه الإجراءات إلى إغلاق المكاتب المحلية للخطوط الجوية القطرية في هذه الدول، مدمّرةً بذلك الاستثمارات الكبيرة التي ضخّتها الناقلة في هذه الأسواق، مما ألحق أضراراً باهظة بشبكة وجهاتها العالمية. وعلى وجه الخصوص، تضمنت هذه الإجراءات، على سبيل المثال لا الحصر، إغلاق المجال الجوي لهذه الدول ومطاراتها أمام طائرات الخطوط الجوية القطرية، وإلغاء تراخيص وتصاريح الخطوط الجوية القطرية للعمل فيها. ومع استمرار هذه الإجراءات حتى يومنا هذا، ما تزال أثار هذا الحصار تقوّض عمليات الناقلة الوطنية لدولة قطر.

وتسعى الخطوط الجوية القطرية إلى الحصول على تعويض كامل عن هذه الأضرار من خلال طلبات للتحكيم الدولي في منازعات الاستثمار التي تم تقديمها بموجب ثلاث معاهدات منفصلة، وهي: اتفاقية الاستثمار التابعة لمنظمة التعاون الإسلامي، والاتفاقية العربية للاستثمار، ومعاهدة الاستثمار الثنائية بين دولة قطر ومصر. وتوضّح إشعارات طلب التحكيم بأنه من خلال الإجراءات التي اتخذتها دول الحصار ضد الخطوط الجوية القطرية، فإنها قد انتهكت الالتزامات المتعلقة بدورها في الاتفاقيات المذكورة، بما في ذلك مصادرة استثمارات الخطوط الجوية القطرية وعدم حماية هذه الاستثمارات بشكل كاف، والتحامل على الخطوط الجوية القطرية، وعدم تقديم معاملة عادلة ومنصفة للناقلة واستثماراتها.

تعليقاً على تقديم طلبات التحكيم الدولي في منازعات الاستثمار، قال سعادة السيد أكبر الباكر، الرئيس التنفيذي لمجموعة الخطوط الجوية القطرية: “إن القرار الذي اتخذته دول الحصار الأربع بمنع الخطوط الجوية القطرية من العمل في أسواقها والطيران في مجالها الجوي يشكّل انتهاكاً صريحاً لاتفاقيات الطيران المدني من جهة، ولعدة اتفاقيات ومعاهدات ملزمة وموقّعة من قبل هذه الدول من جهة أخرى. وبعد أكثر من ثلاثة أعوام من الجهود لحل هذه الأزمة ودياً من خلال الحوار الذي لم يسفر عن أي نتائج، اتبعنا كافة الوسائل التي من شأنها إنصافنا قانونياً، من أجل حماية حقوقنا والحصول على تعويض كامل عن الانتهاكات التي تعرضنا لها. ونرى أنه لا بد من محاسبة دول الحصار عن ما بدر منها من ممارسات غير قانونية في قطاع الطيران، بما في ذلك عدم الوفاء بالتزاماتها بموجب الاتفاقيات الثنائية والاتفاقيات متعددة الأطراف، وفق أحكام القانون الدولي”.

وأضاف سعادة السيد أكبر الباكر: “تعدّ الخطوط الجوية القطرية إحدى شركات الطيران الرائدة على مستوى العالم، حيث تقدّم أعلى مستوى من الخدمات في مجال نقل المسافرين جواً، وفي مجال الشحن الجوي. وبالرغم من مساعي دول الحصار للإضرار بنا، حافظنا في الخطوط الجوية القطرية على مكانتنا العالمية، وسنواصل جهودنا للتأكيد على أن السفر جواً حق للجميع”.
