Fines for people who are behind in registering the national address

Lt. Col. Dr. Abdullah Zayed Al-Sahli, Head of the National Address Department for Public Security, confirmed that registering the national address will be one of the data required to obtain the services or to complete transactions provided by the state as of July 25th.

Dr. Al-Sahli said in remarks to al-Raya that registration at the national address will remain available after July 25th, but with the defaulted incurring the fines contained by the law. Noting that if registration is not completed within the specified period, the violator will bear all the legal implications of this under Article 6 of the Law, which stipulates that “taking into account the provisions of Article 37 of the Penal Code issued by Law No. (11) of 2004 With no violation of any harsher penalty provided by another law, a fine of not more than 10,000 riyals shall be punished for anyone who violates any of the provisions of articles 3 and (4) of this law or deliberately to inform the competent authority of data other than True about his national address.”

He reiterated that persons who were unable to register their national address from residents or nationals  because they were abroad at the time of the law’s introduction for study or treatment, because of the Corona outbreak or for any compelling reason, could provide proof of this when they return to the country to be considered. He noted that there will be flexibility in dealing with these cases. He stressed that in the event of a change in the data of the national address of any person, he must modify this data through Metrash2 or the website of the Ministry of Interior, because if not modified judicial announcements will reach the address available to the Ministry, and the person will bear all the legal implications of this.

He noted that article 4 of the Act stipulated that the person commissioned must notify the concerned authority of any modification or change in the data of his national address and update it in the manner and dates of a decision of the Minister,

If the commissioned person does not notify the specialist of the amendment or change of the data of his national address once it is changed, his judicial declaration or official notification of the national address fixed to the specialist is deemed valid and productive for all its legal implications as stipulated in article 5 of the Act.

He stressed that the aim of the national address is a qualitative shift by moving from traditional correspondence to digital correspondence to serve all citizens and residents in their dealings with various governmental and non-governmental entities.

أكّد المقدَّمُ الدكتورُ عبدالله زايد السهلي رئيس قسم العنوان الوطني بالأمن العام أنّ تسجيل العنوان الوطنيّ سيكون أحد البيانات المطلوبة للحصول على الخدمات أو إنجاز المعاملات التي تقدّمها الدولة اعتبارًا من الخامس والعشرين من شهر يوليو المقبل.

وقال د. السهلي، في تصريحات لـ الراية ، إن التسجيلَ بالعنوان الوطني سيظل متاحًا بعد الخامس والعشرين من يوليو، لكن مع تحمّل المتخلّفين للغرامات الواردة بالقانون.. مشيرًا إلى أنه حال عدم التسجيل خلال المدة المحددة، سيتحمل الشخص المخالف جميعَ الآثار القانونية المترتبة على ذلك والواردة بالمادة السادسة من القانون التي نصّت على أنه «مع مراعاة أحكام المادة (37) من قانون العقوبات الصادر بالقانون رقم (11) لسنة 2004 ومع عدم الإخلال بأي عقوبة أشدّ ينصّ عليها قانونٌ آخر، يعاقب بالغرامة التي لا تزيد على عشرة آلاف ريال كل من خالف أيًا من أحكام المادتَين (3) و(4) من هذا القانون أو تعمّد إبلاغ الجهة المختصة ببيانات غير صحيحة عن عنوانه الوطني». وجدّد التأكيد على أنّ الأشخاص الذين تعذر عليهم تسجيل عنوانهم الوطني من المواطنين أو المقيمين نظرًا لتواجدهم بالخارج وقت بدء تفعيل القانون بغرض الدراسة أو العلاج أو بسبب تفشّي وباء «كورونا» أو لأيّ سبب قاهر، بإمكانهم تقديم ما يثبت ذلك عند عودتهم للبلاد ليتم النظر في حالتهم.. مشيرًا إلى أنه ستكون هناك مرونة في التعامل مع أصحاب هذه الحالات. وشدّد على أنه حال حدوث تغيير في بيانات العنوان الوطني لأي شخص، عليه تعديل هذه البيانات عبر مطراش2 أو الموقع الإلكتروني لوزارة الداخلية، لأنّه حال عدم التعديل سوف تصل الإعلانات القضائية على العنوان المتوفر لدى الوزارة، ويتحمّل الشخص كل الآثار القانونية المترتّبة على ذلك.

ونوّه بأنّ المادة 4 من القانون نصّت على أنه يجب على المُكلّف إخطار الجهة المُختصة بأيّ تعديل أو تغيير يطرأ على بيانات عنوانه الوطني وتحديثه بالطريقة وفي المواعيد التي يصدر بها قرار من الوزير، وإذا لم يقم المُكلّف بإخطار الجهة المُختصة بالتعديل أو التغيير الذي طرأ على بيانات عنوانه الوطني أو تحديثه حال تغييره، اعتبر إعلانه القضائي أو إخطاره الرسمي على عنوانه الوطني الثابت لدى الجهة المُختصة صحيحًا ومنتجًا لكافة آثاره القانونية كما نصّت على ذلك المادة 5 من القانون. وأكّد أنّ الهدف من العنوان الوطني هو نقلة نوعية من خلال الانتقال من المراسلات التقليدية إلى المراسلات الرقمية بما يخدم جميع المواطنين والمقيمين في تعاملاتهم مع مختلف الجهات الحكوميّة وغير الحكوميّة.
